On May 4, 2023 at 8:30 am, Licensing Program Analyst (LPA) Susana Martinez conducted an unannounced required 1-year inspection. LPA was greeted at the door by licensee Ximena Villalba. LPA provided business card and advised her of the purpose for the inspection. At the time of inspection there were 10 children present along with 2 fingerprint cleared assistants and licensee. Together with the licensee, LPA toured the home inside and outside. Licensee denies having guns/ammunition in the home.

The licensee uses the living-room, one bathroom and outdoor patio for childcare. At 8:34 am, LPA observed licensee testing the carbon monoxide detector located in the hallway. LPA found the carbon monoxide detector to be in working condition. Smoke detectors were also observed to be located throughout the home; in the hallway and living-room. The living-room has a fire place that is fully covered and barricaded preventing children from having access. LPA observed cleaning chemicals to be located in the laundry room which is off-limits to children in care. The kitchen sharps are located in a drawer with a child safety lock. A regulatory fire extinguisher was observed to be located in the kitchen with a receipt showing a purchase date of 1/12/23. Licensee was reminded to service or purchase a fire extinguisher yearly.

The outdoor play area was found to be fully enclosed with sufficient shade and age-appropriate toys. LPA observed a large-breed dog in the home. Licensee provided proof of vaccines to LPA. LPA confirmed all vaccines are up to date. Licensee also has a bunny in the home which was found to be located in the laundry room. The required licensing documents were observed to be mounted on the living-room wall. LPA reviewed the children's roster and was able to confirm it is up to date. LPA asked if disaster and fire drills have been conducted, licensee states yes. LPA asked if drills are being documented, licensee states yes but could not produce proof of documentation. LPA provided a template and reminded licensee that drills must be conducted and documented every 6 months.

LPA observed a 7 month old infant in care (C1). LPA asked licensee for safe sleep log, LPA observed safe sleep log to be up to date. LPA asked licensee if infant sleeps in a crib or pin, licensee states neither. At 8:52 AM Licensee showed a picture of C1 sleeping on a mat fully swaddled with a blanket. The picture was dated 3/8/23. LPA issued a Type B citation for swaddling an infant and advised licensee swaddling is prohibited in day care homes. At time of record review, LPA did not observe the Individual Infant Sleep Plan (LIC9227) in the child's records. LPA explained and provided a copy of LIC9227 to licensee. Licensee is to send C1's completed LIC9227 by 5/8/23. LPA asked if licensee received PIN's, licensee stated yes. LPA provided licensee with a copy of PIN 20-24-CCP-SP Regarding Safe Sleep Regulations.

LPA reviewed five out of five children files. One out of five children's records was found to be missing immunization's. LPA issued a Technical Violation and reminded licensee that all children's records must be complete and up to date. Licensee CPR/first aid is valid through 10/2024. Assistant's CPR/ first aid certifications were also found to be valid. Licensee was reminded a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter certification AB1207 every two years at www.mandatedreporterca.com Licensee's mandated reporter certification was found to be valid through 9/2023. Assistant's mandated reporter certifications were also found to be valid. LPA reviewed assistant's files and found immunization records to be missing for both assistant's. Licensee states she must have misplaced them and states she will be sending proof of immunization's to LPA by 5/5/23. LPA issued a Technical Violation for missing immunization's records.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep web page at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA observed a safe sleep log being documented for infants in care every 15 minutes.

Licensee advised there were no children in care that required Incidental Medical Services. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Two Type B deficiencies and four technical violations were issued during today's visit. Appeal Rights were given and explained.



LPA provided a copy of the Entrance Checklist (LIC126). LPA advised licensee to use this form as a guide when putting personnel and children's records together.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed in Spanish with the licensee Ximena Villalba.
