Licensing Program Analyst (LPA) conducted a subsequent visit to deliver the findings for the above allegation. LPA met with Director Marcella Tarin.

Based on LPA's observation on several occasions on, 5/12/23, 5/16/23 and on 5/24/23 , LPA observed staff from a roofing company working on the roof. LPA was informed by District Leader Jennifer Liu and Director Marcella Tarin that the sections of the center's roof had been damaged due to the recent rain storm and water had entered inside some of the walls inside the center during the evening of May 8, 2023.

The Center closed the from May 9 through May 12, 2023. The parents were given the choice to relocate their child/dren at another Kinder Care for that week. Although the center re-opened on May 12,2023, the roof work continued causing the Central Air Vac System to cease. As a result, the Center had placed A.T. Portable HVAC Coolers into each of the center's classrooms. On 5/16/23, the Central Air Vac system was fully operational.

On 5/12/23, LPA observed three Air Temporary Portable HVAC Coolers set at 70f in the three classrooms. On 5/16/23, LPA measured the temperatures in Classroom 4/5 at 74f degrees at 1:57pm, Classroom 6, measured 77f degrees at 2:00pm, Classroom 3 temperature measured 74f degrees at 3:15pm. On 5/16/23, LPA observed that the central air system was fully operational which District Leader Jennifer Liu confirmed.
On 5/24/23, LPA observed that all of the Air Temporary Portable HVAC Coolers were removed, and the central air system was operating. Air temperature measured 71f in Room 3, 70f in Room 4/5 and 70f in Room 6.

Based on the staff interviews, staff stated that although the Air Temporary Portable HVAC were present and operating, their classroom's remained warm, and on several occasions had to take the children outside to the playground. Staff stated that they did not know the temperature inside their classrooms.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the above allegation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
