25 | Licensing Program Analyst (LPA), Oscar Huang, met with teacher Cesar Herrera for a case management inspection in response to an unusual incident that was reported by the facility on April 29, 2019. The incident occurred on April 22, 2019 involving a five-year-old child. LPA toured the facility, interviewed staffs, and reviewed the child file. Based on interviews with the staffs, LPA concluded that the child who left the line and went to the bathroom by herself and stayed unattended in the classroom while all other children of the classroom were playing outdoor with staffs.
Due to result of the investigation, the facility is cited with type "A" deficiency for for violating Care and Supervision, 101229(a)(1). No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1) on the attached LIC 809-D. A notice of site visit was issued and must be posted near the facility entrance along with the Type "A" deficiency and must remain posted for 30 consecutive days.
LPA discussed the reporting requirements of AB633 to Teacher Herrera and provided him with a copy of Acknowledgement of Receipt of Licensing Reports (LIC 9224) and he understands the requirements. Upon receipt, the facility shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months, and obtain the signatures from the parents and keep it in each child's file.
An immediately Civil penalty of $500 was assessed due to the zero tolerance.
