On 04/09/2024 at 10:00am, Licensing Program Analyst (LPA), Farida Raja, conducted an unannounced Required - 3 Year inspection. LPA was granted access to the home by Licensee, Olga Garcia and explained the nature of today’s inspection. Licensee stated that she is not providing care to children at this time and only cares for her school age niece and grandchildren. Licensee stated that she has not been providing care since March 2020. Present in the home were licensee and spouse. Licensee stated that her hours of operation are 7:30 am- 5:00 pm. No children were observed during today's inspection. The adults that reside in the home are Licensee, spouse and son. No minor children reside in the home.

Licensee provided an updated Application for Family Childcare Home License (LIC 279) to LPA during today's inspection. Licensee will submit an updated Facility Sketch (LIC 999) and an updated Emergency Disaster Plan (LIC 610A) along with relocation letters to LPA by 04/23/2024. LPA provided information regarding Inactive Status and informed Licensee that she can go inactive and inform the Department when she would like to be operational again as she is only caring for family. LPA explained the conditions of inactive license. Licensee stated that she receives subsidized care for her niece which she may not receive if she is inactive.

LPA toured the indoor and outdoor areas of the home during today's inspection. Licensee has a working telephone in the home (408-655-4763). Licensee stated that she currently provides care in the family room. LPA observed that stairs to the second level were not barricaded and LPA informed Licensee to barricade stairs when caring for children under 5 years of age. LPA provided Licensee with an Entrance Checklist (LIC 126). Licensee has current CPR/First Aid certification that expires on 8/28/2024 and Mandated Reporter Training which expires on 9/3/2024. Licensee has the required measles, pertussis and influenza immunization's. All adults residing in the home have received criminal record and child abuse index clearances or exemptions. LPA observed a fireplace barricaded with a glass cover in the family room of the home.

The home has central heating/cooling and ventilation for comfort of children. LPA observed gardening and construction machinery and equipment in the backyard area. Licensee stated that her grandchildren and niece do not use the backyard at this time. Both sides of the home are gated and LPA observed an off limit shed in the backyard area of the home. There are no bodies of water observed. LPA observed that the bathroom used by children was in operating condition. Toilets and faucet are clean and operable.

LPA observed a 3A40BC fire extinguisher in the dining area that needs to be serviced and working smoke/carbon monoxide detectors. Licensee states that she does not have any weapons in the home. Licensee has 3 dogs in the home. All detergents, cleaning compounds, poisons, medications, sharp objects and other similar items were observed to be stored inaccessible to children. Licensee understands that smoking is prohibited in the home.

Licensee states that she provides meals and snacks to the children in care. Licensee understands that any food brought from home shall be labeled with each child's name and properly stored or refrigerated. Licensee stated that has not conducted a fire drill and LPA informed her that fire drills need to be conducted every 6 months and documented with the date, time and number of children participating. LPA reviewed a facility roster and obtained a copy during today's inspection.

Licensee does not have liability insurance for the day care and will issue the Affidavit Regarding Liability Insurance for Family Child Care Home to all families. Licensee stated that she does not plan to care for children under two years of age. LPA reminded Licensee to follow all safe sleep regulations including conducting 15 minute sleep checks if caring for infant under 2 years of age.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee stated that she is not providing any medication at this time. Licensees stated that she does provide transportation. LPA reminded Licensee that children cannot be left in parked vehicles unattended at any time, the motor vehicles used to transport children shall be maintained in safe operating conditions, and all vehicle occupants must be secured in an appropriate restraint system.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, Licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. LPA advised Licensee to complete all corrections prior to providing care to daycare children. As a result of today's inspection, there were no deficiencies cited. Exit interview conducted and report was reviewed with Licensee, Olga Garcia.
