Licensing Program Analysts (LPA) Anna Morales conducted an annual inspection and was greeted by Licensee Ana Ochoa-Chacon. Present in the home were 9 children of whom 1 was infant age, Licensee’s assistant Claudia De La Torre and husband. LPA observed a current Children's Roster. Days and hours of operation are Monday through Friday from 7:30 AM –5:00 PM. Licensee understands the capacity options and understands that the maximum capacity is 14 children. Last disaster drill was conducted on 5/2/2023.

There are three adults residing in the home; Licensee, Licensee’s husband, and adult son. Adults in the home have Clearances for Criminal Background and Child Abuse Index Background Checks, and Tuberculosis.

LPA inspected the indoor and outdoor areas of the home today. LPA observed a Smoke/ Carbon monoxide detector, and a fully charged fire extinguisher. Off limits area in the home are all three Bedrooms, Master Bathroom, front living room, and Garage. The Day care is located in the back part of the house. Parents enter through the back of the house. LPA observed a fully fenced back yard that is used for outdoor activities. No bodies of water were observed. Licensee stated that she does not have any weapons and no one residing at the home smokes. Licensee has a small dog, who does not interact with the children and is kept separate from the day care area.

LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee stated that she does not transport children, and does not provide Incidental Medical Services (IMS).Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee have an area where sick children can be isolated from the others until parent pick-up.

Licensee provides meals and snacks to the children. Licensee stated that she serves breakfast, lunch and snacks.

Licensee's Mandated Reporter Training (AB1207) expires on 9/8/2024.
LPA discussed Senate Bill 792, Assembly Bill (AB) 1207 (Mandated Child Abuse Reporting Training) which is required training that began on January 1, 2018 and requires renewal every two years, AB 633 was discussed with Licensee. Licensing forms, Title 22 regulations, can be obtained through the internet at www.ccld.ca.gov. Mandated Reported Training can be accessed at www.mandatedreporterca.com.

LPA reviewed a random selection of children’s files for the following records: Notification of Parents Rights (LIC995A), Consent for Emergency Medical Treatment (LIC627), Identification and Emergency Information (LIC700), and Immunization Records (PM286).
Licensee's and staff file was reviewed for the following records: Employee Rights (LIC9052), Criminal Record Statement (LIC508), Statement Acknowledging Requirement to report Child Abuse (LIC9108), and Immunization Record showing immunity to measles (MMR), pertussis (Tdap), and influenza (or statement declining influenza). Licensee does have a current Pediatric First Aid/CPR and it expires on 6/25.

LPA reminded Licensee of the applicable civil penalties for those adults who have not received fingerprint clearances, are not associated to the license and who comes in contact with or provide care and supervision to the children. Penalty amounts: $100.00 per person per day, minimum of $100.00 to a maximum of $500.00 per person for an initial violation and a minimum of $100.00 to a maximum of $3000.00 per person for any subsequent violation within a 12- month period.

LPA discussed the requirements of AB 633 with the Licensee and understands the AB 633 fact sheet/copy of Acknowledgement of Receipt of Licensing Reports (LIC 9224). LPA discussed "zero tolerance" related regulations and advised that the assessment of an immediate $500 per day civil penalty for any violation of a "zero tolerance" related regulation. An ongoing civil penalty of $100 per day continues until the violation(s) is corrected.
Exit Interview was conducted with Licensee. One Technical Deficiency is being issued at today's visit. No Deficiencies are being cited based on the LPA's observations, interviews conducted and records reviewed in accordance with the California Code of Regulations Title 22.
