Licensing Program Analyst (LPA) Stephanie Collins conducted an unannounced subsequent complaint visit today and met with Josefina Garcia-Castillo,Center Director. Purpose of today's visit is to follow up on a complaint investigation and deliver investigation findings. The investigation of the allegation listed above was conducted by LPA. On 10/24/2022, LPA arrived unannounced and toured the facility with Director. In the playground area, LPA observed a tree stump protruding from the ground. The tree stump was not properly barricaded off to ensure the area of concern was inaccessible to children.This poses a hazard to the health and safety of the children in care. During the inspection, the director was observed closing the playground off by posting a “Playground Temporarily Closed" notice” on the playground fence.
Based on interviews conducted and LPA’s observation of the building and grounds during the investigation, the above allegation is found to be SUBSTANTIATED, meaning the preponderance of the evidence standard has been met.
A deficiency is being cited. Exit interview conducted with Director where this report was discussed. Appeal rights were also provided during visit.

A NOTICE OF SITE VISIT WAS GIVEN AND MUST REMAIN POSTED FOR 30 CONSECUTIVE DAYS.

101238 Buildings and Grounds (a) The childcare center shall be clean, safe, sanitary, and in good repair at all times to ensure the safety and well-being of children, employees, and visitors.
This requirement was not met as evidenced by:

A large tree stumped was protruding out of the ground on the playground, the earth is un-level with overgrown grass, and gopher holes. Wood/lumber with jagged edges is sticking up from the walkways. Playground is need of maintenance. This poses a risk to the health, safety, and personal rights of children in care.

The Site Director closed playground and posted a Temporarily Closed Notice on the entrance gate of playground.
Per Site Director, when play -round is safe and free of hazards she will send submit pictures to the CCL Office notifying the playground is open and safe for children in care.
