On 4/5/24 around 9am Licensing Program Analyst (LPA) Sheena Chin arrived at the facility. The licensee’s mom answered the door. The licensee was in the master bedroom. Around 9:20am LPA met with Licensee, Rosie Lara - Ramirez, and explained the purpose of the visit, an unannounced annual inspection. Present during today’s inspection were the licensee, her mom and 6 children in the facility. Days and hours of operation are Monday to Friday, 6:00am to 6:00pm. The adults that reside in the home are the licensee, her husband and her mother. The licensee stated that she rented the house.

Observation
When LPA arrived the facility, the licensee was in the master bedroom. The licensee’s mom answered the door and left 5 kids supervised by the licensee’s daughter, who did not have background and immunization clearances. The licensee's daughter stated that she's the helper. LPA observed a 2-year-old child, C1, was left alone in the living room, where was unable to be visually supervised from the family room where the staff was. The licensee stated that she used the camera to monitor the child, but the portable camera was not put in the living room where the child was left alone. LPA advised the licensee that children in care need to be supervised at all times and that anyone who has contacts with children in care must have background and immunization clearances. Around 1140am, two more children arrived in the facility.

Observation
LPA observed that required postings were posted in two different places. The license was posted in the outside of the front door. The Parents’ Rights and Emergency & Disaster plan was posted in the day care area. LPA, along with the licensee toured the inside and outside of the home. The facility has a full charged fire extinguisher, 3A40BC. Carbon monoxide and smoke detectors are working properly. The off-limit areas inside in the home are the second floor, all the bedrooms on the first floor, kitchen, and garage. LPA observed a fireplace blocked by a mesh. The licensee stated that the previous barricade she used was movable so she changed to the mesh to block the fireplace.

LPA observed that cleaning supplies and bleach were put on the top of the washer and dryer in the bathroom, accessible to children. LPA observed there’re 2 dogs in the facility. One was in the off-limit and the other one with safe corn around its neck was in the backyard. The licensee stated that she separated the dog and children in care. When children were inside, the dog would be outside vis versa. LPA observed that there are toys for children. LPA observed the backyard had a shed, which was not included in the facility sketch. LPA advised the licensee to update the facility sketch. LPA conducted CARE Tools for this annual inspection, which include Physical Plant, Care and Supervision, Facility Administration, Records, Staffing Ratio and Capacity, Personnel Rights for compliance with all licensing statutes, regulations, and interim licensing Standards, and results were documented on the tool.

Records review
The Licensee has current CPR and First Aid certifications expiring 3/21/26. The Licensee has the child abuse training certificate, expiring 12/4/24. LPA reviewed the fire and disaster drills log which is to be done at least once every six months. The last drills were conducted on 10/3/23. The licensee stated that the facility was scheduled to have the fire drill on 4/8/24.

LPA reviewed children files. Immunization records were not maintained and updated in form PM 286. LPA observed Notification of Parents’ Rights is in each child’s file. 15 min. sleeping check logs for infants under 2 years old were not documented and maintained for C3 and C7. The helper did not have current mandated reporter training certificate.

Records review
During today’s inspection, all adults present or residing in the home have criminal record clearances required by the Department. Licensee stated that 2 adult children would come back home for summer breaks. LPA advised the licensee that the best practice is to have all the adult children fingerprinted and have immunization clearances if the adult children would help in the facility during summer breaks.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Discussion


Supervision of children was discussed with Licensee, who understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee understands her capacity options. Licensee states that she does not transport children via vehicle but she understands that children cannot be left in parked vehicles unattended at any time.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Discussion
Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Deficiency

LPA advised the director to print out this licensing report and deficiency report for parents to review and have parents sign LIC 9224 form. LPA advised the director that a copy of this report shall be provided to parent/guardian of any newly enrolled children for the next 12 months. LPA advised the director to post this report and the Notice of Site Visit for 30 days. Failure to maintain postings as required will result in an immediate $100 civil penalty.
