Licensing Program Analyst (LPA) Pete Hernandez conducted an unannounced annual inspection at the home today. LPA met with Maria Fomina, Licensee, and explained the nature of today's visit to her. Present in the home was the licensee, her assistant Margarita Lelekova, and 11 children, 1 of which are under 2 years old. Licensee lives in the home with her husband and two minor children. Hours are Monday - Friday from 8:00 AM to 6:00 PM.

LPA inspected the inside and outside of the facility. Off-limit areas outside include both sides of the home. The right side is gated and the other is barricaded by a bench. Inside the home the off limits areas are all 3 standard bedrooms, the master bedroom, laundry room and half bathroom, and the garage. Licensee acknowledged that children may never enter these off-limit areas. The backyard is fenced and licensee acknowledges that children may never be left unsupervised in an unfenced area of the yard. LPA didn't observed any bodies of water. Licensee understands that all pools, spas, hot tubs, fish ponds, or similar bodies of water shall be covered or fenced as specified in title 22 regulations to be inaccessible to children. Licensee acknowledged that children may never enter these off-limit areas. Fire drills are conducted every six months and logged. Children's Roster is maintained and current. The Licensee has a working telephone in the home. LPA observed sufficient materials, toys, and play equipment for the day care children. The home is orderly, and safe for the day care children.

LPA observed 1 fully charged 2A10BC fire extinguisher. There are working smoke & carbon monoxide detectors in the home. The licensee stated that her husband does have a weapon locked away in the garage with the ammunition locked away separately.All detergents, cleaning compounds, other similar items and poisons are in the garage and are inaccessible to children.

Licensee nor assigned helpers have current Mandated Reporter Certificates. LPA discussed Senate Bill 792, Assembly Bill (AB) 1207 (Mandated Child Abuse Reporting Training) which is required training that began on January 1, 2018 and requires renewal every two years, AB 633 was discussed with applicant Licensing forms, Title 22 regulations, can be obtained through the internet at www.ccld.ca.gov. Mandated Reported Training can be accessed at www.mandatedreporterca.com.

Licensee has a current CPR and First Aid card that expire on 6/30/2021.

LPA reviewed the files of 6 enrolled children and the file of one helper, Margarita Lelekova, all the files have all of the required documentation and immunizations.

Incidental Medical Services (IMS) policy was discussed.When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. A review of staff records today indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. LPA also reminded Licensee of the applicable civil penalties for those adults who have not received fingerprint clearances, are not associated to the license and who come in contact with or provide care and supervision to the children. Penalty amounts: $100.00 per person per day, minimum of $100.00 to a maximum of $500.00 per person for an initial violation and a minimum of $100.00 to a maximum of $3000.00 per person for any subsequent violation within a 12- month period

Supervision of children was discussed with the Licensee. Licensee understands that she must be present in the home at least 80 percent of the hours the day care is in operation and ensure that the children are supervised at all times. The Licensee understands her capacity options. The Licensee states that she does not transport children and understands that children cannot be left in parked vehicles unattended at any time. Licensee understands that children's personal rights should not be violated; including no corporal punishment. Isolation of sick child, requirements for reporting suspected child abuse, unusual incidents/injuries, heat-related illnesses, and requirements for assistant/substitute were also discussed.

Per LPA's review of files, Licensee and Helpers do not have Mandated Reporter Training per AB1207. Licensee stated she was unaware of the requirement. This poses a potential risk to the health and safety of children in care.
