As per PIN 20-08-CCP that beginning March 26, 2020 Licensing Program Analysts (LPAs) will conduct tele-inspections as part of Community Care Licensing Division’s (CCLD) emergency response to the spread of Coronavirus Disease 2019 (COVID-19).

On 02/11/2021 at 10:00 am, Licensing Program Analyst (LPA) Manel Estoesta conducted an announced tele-inspection, pre-licensing visit via Zoom Virtual Video Conference. LPA met with the applicant/licensee, Neale Marquez. Present on this visit were the licensee's fingerprint cleared spouse Jeffrey Marquez, volunteer Graciella Gutiza, licensee's/applicant's son Jeffrey Owen Marquez, and eight children in care of whom two were infants, four preschool children, one transitional kindergarten and one school age child.

The applicant has submitted a Capacity Increase application from a small family childcare home license. The facility address is 959 Coventry Circle, Milpitas, CA 95035. The home was virtually toured to conduct a health and safety inspection. Applicant stated that the hours of operation will be from Monday to Friday 7:00 am to 6:00 pm.

The home is a single family two story, four bedroom and 2.5 bathroom home. The applicant/licensee owns the home and a copy of deed submitted. The home is neat, clean with heating, ventilation for safety and comfort.

The On-Limit areas are the living room, half bathroom, kitchen, dining room, family room and backyard. There are no accessible hazardous cleaning chemicals the on-limit areas. The Off-Limit areas are the garage, side yards, the whole second floor which include the four bedroom and 2 bathroom. LPA reminded applicant/licensee that Off-limit areas must be inaccessible to children in care by closed and or locked doors and or a fence. LPA reminded the applicant that any structural changes to the home or additions to the childcare facility must be reported to Community Care Licensing. The applicant/licensee understood.

The home has a first aid kit, a fully charged 2A10BC fire extinguisher, functioning smoke detector and carbon monoxide, and a working telephone. Applicant stated that there are no firearms in the home. The home wall AC/heater has a locked door and living room fireplace is completely fenced.

Applicant has ample age-appropriate toys and learning materials. LPA discussed that baby bouncers & drop-down cribs are not allowed at the day-care facility. LPA discussed children and teacher ratio. LPA discussed the LIC 311D - Forms/Records To Keep In Your Family Child Care Home. The applicant/licensee understood.

The applicant/licensee has completed the Preventive Health and Safety training. LPA advised applicant/licensee that Lead Poisoning Prevention Training was added to the Preventive Health and Safety Training effective 07/01/2020, can be taken separately, it is not required at this time, however when enrolling or re-enrolling any child, licensee have to provide the parent and or guardian with written information on the risks and effects of lead exposure, blood lead testing recommendations and requirements, and options for obtaining blood lead testing, as specified. Applicant understood. The applicant/licensee Pediatric CPR and First Aid training expires on 03/02/2021. The applicant completed the California Child Abuse Mandated Reporter Online Training for Child Care Providers (AB1207) on 01/07/2021. LPA reminded the applicant/licensee that he California Child Abuse Mandated Reporter Online Training for Child Care Providers (AB1207) expires every 2 years.

LPA discussed with the applicant/licensee the new background check data system, Guardian. Guardian’s implementation was on January 15, 2021 published PIN 21-01-CCLD on January 12, 2021.

Applicant's/licensee's spouse has completed the Preventive Health and Safety training, Pediatric CPR and First Aid training expires on 09/07/2021.

Incidental Medical Services (IMS) policy was discussed. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The applicant/licensee is using an electronic sign in and out system names as "Bright Wheel."

The fire clearance STD 850 Fire Clearance Inspection for the capacity increase application was received and approved on 02/03/2021.

This home is recommended for a Large Family Child Care Home and Large Family Child Care Home license granted as of today's date, Thursday, February 11, 2021. A copy of the license will be mailed to the applicant/licensee.

The LIC 809 Facility Evaluation Report will be printed, mailed and the licensee/applicant will sign and submit the original copy to the Oakland South East Regional in a timely manner. This report shall remain on file for 3 years.
