On 05/22/2023 at 9:05am, Licensing Program Analyst (LPA), Farida Raja, arrived for an unannounced 1- year annual inspection. The door was answered by a person working on the backyard who stated that Elaine was not home and he will let staff know. At 9:15am, LPA was granted access to the home by Staff, Patrice Duncan, and explained the nature of today’s inspection. Staff stated that Licensee, Elaine had run to the store and will be back soon and they usually use the left side entrance for the daycare. Licensee arrived at 9:30am. Present in the home were licensee, two staff- Patrice Duncan and Karla Martinez, and nine children including 4 infants and 5 preschool age. Licensee was operating within the ratio and capacity requirements of her license. Days and hours of operation are Monday to Friday 7:00 am to 5:30 pm. LPA observed all required posted materials in the garage area which is used for daycare purposes. The adults that reside in the home are Licensee and adult daughter-Leah Walker.

LPA toured the indoor and outdoor areas of the home during today's inspection. Licensee has a working telephone in the home (408-836-4293). LPA observed sufficient materials, toys, and play equipment for the day care children. Furniture, such as tables, chairs, cubbies, cribs, feeding chairs and shelves, are in good condition. The floors were free of tripping hazards. The home has central heating/cooling and ventilation for comfort of children. The home is single story. Off limit areas inside the home: entire home except for converted garage and one bathroom. Children enter the daycare through a side gate next to the main activity room (converted garage). Off limit areas outside the home: right side section. Backyard is fenced and both sides of the home are gated. LPA observed that the bathroom used by children was in operating condition. Toilets and faucet are clean and operable. The shower area is free on any hazards.

LPA observed a fully charged 2A10BC fire extinguisher in the converted garage area, working smoke/carbon monoxide detectors and fire pull alarm. The Licensee states that she does not have any weapons and has one dog in the home. All detergents, cleaning compounds, medications, sharp objects and other similar items are stored inaccessible to children. All poisons are inaccessible to children. Licensee understands that smoking is prohibited in the home.

Drinking water is readily available for children in the home via individual water bottles, sippy cups and through a pitcher and disposable water cups. Licensee states that parents bring all meals for the infants and she provides breakfast, AM and PM snack and lunch for the preschoolers. Licensee understands that any food brought from home shall be labeled with each child's name and properly stored or refrigerated.

LPA reviewed a current Child Care Facility Roster and Fire/Disaster drill log during today's inspection. Fire/disaster drill was conducted on 05/10/2023. LPA obtained copy of children's roster. Children file review was completed and found to be current and up to date. Eight (8) children’s files were reviewed during today's inspection. Licensee states that she has liability insurance through Markel Services Incorporated and LPA observed a current policy verifying valid coverage. LPA reviewed two (2) files for children under 12 months and the files were complete with the required forms, including the Individual Infant Sleeping Plan (LIC 9227). LPA observed log of 15-minute checks conducted for all sleeping infants.

Staff file review was completed and found to be current and up to date. All individuals have clearances for Tuberculosis, Criminal Background, and Child Abuse Index Checks. LPA reviewed three (3) staff files (Licensee and two assistants) and the files were complete with the required forms. Licensee's Pediatric CPR/First Aid certification expired on 05/16/2023 and licensee provided email proof of making arrangements to renew training. Licensee has proof of immunization in file for measles, pertussis and statement declining influenza vaccine. Licensee and staff are current with Mandated Reporter Training for Child Care Workers. Licensee's Mandated Reporter Training expires on 8/17/2024. Licensee understands the training is mandatory to all Licensees and adults in the home in contact will children and requires renewal every two years.

Supervision of children was discussed with Licensee, and she understands that she or a qualified adult must be present in the home during day care hours and ensure that the children are supervised at all times. The Licensee understands her capacity options and she understands that she cannot have more than 14 children in the home at any time and a qualified assistant must be present. Licensee understands in absence of a helper her license capacity is reduced to 8 and ratio (age of the children) must be observed.

Licensee states that she administers medication to the day care children as needed and has an Incidental Medical Services Plan. LPA reviewed storage of medication, equipment and supplies. The following information regarding Americans with Disabilities Act (ADA) was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm. LPA discussed "zero tolerance" related regulations and advised that the assessment of an immediate $500 per day civil penalty for any violation of a "zero tolerance" related regulation. A $500 immediate civil penalty and $100 per day violation until corrected is assessed for serious violations such as absence of supervision, accessible bodies of water, accessible firearms, refused entry of licensing staff, presence of an excluded person, and violations that result in illness or injury.

Licensee is encouraged to visit the Department’s website at https://cdss.ca.gov/inforesources/child-care-licensing to access general updates, resources for providers, regulations, adoptions of new laws, pay annual fees etc. LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee states that a child will be isolated from the other children in a separate area of the activity room, until parent pick-up, if necessary, due to illness or communicable disease. Licensee states that she does not transport any day care children. LPA reminded Licensee that if she decides to transport children, children should not be left unattended in parked vehicles and that car seats shall only be used for transportation and shall not be used for sleeping.



Exit interview conducted and report was reviewed with the Licensee, Elaine Walker .

As a result of today's inspection, there were no deficiencies cited.
