Due to COVID-19 and DPH (Department of Public Health) guidelines of social distancing, a tele inspection was conducted. A request for an e-mail and telephone number to a device that is equipped to conduct a Tele-inspection was requested. (buddyst@icloud.com)
Licensing Program Analysts (LPA), Stephanie Collins met with Site Director Emma Monica for a pre-licensing tele-inspection. Applicant is applying for a license to operate a Preschool Co-op in conjunction with the Santa Clare County Office of Education (SCCOE). Painter Elementary School is an active school site.
The requested capacity is 24 preschool children ages Three (3) to entry into kindergarten. LPA inspected the indoor, outdoor and off-limit areas, as well as observed the measuring of space available for the children. (Due to COVID-19 sheltering in place) .
Indoor measurements are as follows:

Total 898.09= sq. ft.


Total Preschool Indoor Activity Space = (898.09 sq. ft.) divided by (35 sq. ft. / child) = 25 Preschool children
Facility meets the fixture requirement for capacity of 24 because they have 2 sinks( 30) and 2 toilets (30) designated for Preschool children to use.

There is a staff restroom in the elementary school area (off of the playground) there is a school nurses station with an attached bathroom that can be used as an isolation area for children who become ill. Santa Clara Food Program (Revolution) will be preparing and delivering the daily breakfast and snacks for children to serve themselves during the school program. Children will be required to bring their own lunches. A refrigerator is available to store lunches and snacks. There is counter space available for food preparation well as a sink that has hot and cold running water. LPA observed trash cans with tight fitting covers for the disposal of solid waste. LPA observed functioning smoke detector, and fire extinguishers at the facility. This facility plans to provide Incidental Medical Services – IMS. Facility has submitted a Plan of Operation that includes IMS. Medication will be stored in the cabinets in the classroom inaccessible and out of reach of the children.
The facility staff will clean toys and equipment daily with cleaning wipes and solutions that will be kept inaccessible to children.
The center will be cleaned routinely by staff/custodian. LPA observed toys, furniture, and equipment such as tables, chairs, mats, etc.

The Preschool playground is enclosed by fencing. Areas around and under climbing structures have material that absorbs falls. Shade is provided by trees and building overhang. Drinking water outdoors is available via water fountain, water pitcher and/or disposable cups. The center will not be providing transportation.

A review of staff records during today's visit indicates that That Emma Monica has received a criminal background and child abuse index clearance and is associated to this facility. LPA reminded directors of the applicable civil penalties for those adults who have not received fingerprint clearances, are not associated to the license, who come in contact with or provide care and supervision to the children. Penalties can amounts to $100.00 per person per day, minimum of $100.00 to a maximum of $500.00 per person for an initial violation and a minimum of $100.00 to a maximum of $3000.00 per person for any subsequent violation within a 12-month period.
Child Care Center Lead Testing of Drinking Water Requirement
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires:
Health and Safety Code section 1597.16 requires that all licensed Child Care Centers (CCCs) that were constructed before January 1, 2010, must test their water for lead within a three year window, between January 1, 2020, and January 1, 2023, with subsequent testing every 5 years after the date of the first test. Only CCCs are required to test drinking and cooking water for lead.

Exit interview was conducted, where this report was reviewed with Site Directors Helen Emma Monica.

Based on measurements and availability of sinks and toilets a license for 24 children will be approved pending proof or submission of the following items and management's approval:
1)Carbon monoxide detector
2)Waiver Request with shared playground schedule (Painter's Co-op Preschool and
Painter's Elementary School).
3) Facility Pre-Licensing Inspection Checklist (Signed)
4) Updated Independent Contractor Agreement (Expired)
5) San Jose Fire Dept. Clearance.
A read receipt notification in lieu of a signature will be sent to Applicant, acknowledge of receipt received must be acknowledged within 24 hours. License will not be issued until verification of the report is received.
