Licensing Program Analyst (LPA), Oscar Huang conducted an announced pre-licensing inspection to the Facility today. LPA met with Applicant Huimin Xu and explained the nature of today's visit. Applicant is applying for Change of Ownership with the same capacity currently licensed. Applicant stated that no change was made for the building, nor the staff or children enrolled. The facility is currently operated under license # 434400346 since 1997. LPA toured the Facility both inside and outside during today's visit. LPA inspected Rooms 1, 2, 3, & 4 , and restrooms, as well as outdoor play area. Preschool hours are: 7:30 AM to 5:30 PM Monday to Friday. Fire clearance was granted on 10/27/2021 from San Jose Fire Department: Inspect Entire Building. Approved for child care use up to 40 children. Classroom 1, 2, 3, 4 and outdoor play area, kitchen is off limits.

INDOOR MEASUREMENTS ARE AS FOLLOWS:

OUTDOOR MEASUREMENTS ARE AS FOLLOWS:

69 x 85.667 - 20 x 18.333 - 12 x 4 = 5911.023 - 414.66 = 5496.363

TOTAL INDOOR SPACE: 5496.363 sq. ft. divided by 75 = 73 preschool children.

There are 3 toilets (45) and 4 sinks (60) available for the preschool children. LPA observed dispenser soap and disposable towels in the preschool bathrooms. Staff have one separate bathroom that children can use who become ill while in care. Sick children will be isolated in the director's office area and isolation equipment is provided. The Facility will utilize the 3-step method of soap/bleach/water for disinfecting purposes, the facility is observed as being in compliance with COVID-19 Postings, Guidelines and Protocols. LPA observed the required posted materials, including the Facility License area, Emergency Disaster Plan (LIC 610), Earthquake Preparedness Checklist (LIC 9148), Parents' Rights Poster (PUB 393), Personal Rights (LIC 613A), Child Car Seat Law (PUB 269), and Activity Schedule. There is no active waiver on file for the facility.

LPA observed that all rooms are clean and safe for all children and staff. Drinking water is readily available for the children via water fountain and water bottles that children bring in from home every day. LPA observed solid waste containers with tight-fitting lids in the facility. Staff and children's restrooms are clean, sanitary, and operable. Huimin Xu that there are no weapons or firearms on the premises. LPA informed applicant that walker are prohibited on the premises or No smoking.

LPA observed all furniture, napping mats, and equipment is in good condition and safe for the children. Children bring their own lunch, the facility provides snacks one in the morning and one in the afternoon. The food preparation and storage areas are clean and free of litter & rubbish, and free of rodents and other vermin. Cleaning supplies are inaccessible to the children and stored in high cabinets inaccessible to children. First aid supplies were observed. Working functioning fire extinguisher and Carbon Monoxide detector observed.

LPA observed a fenced outdoor play area and no bodies of water. The play & climb structures are in good condition, with wood bark chips installed under the climb structure to absorb the fall. LPA observed enough shades under the patio roof & tree A cart will used to carry children's water bottles when play outdoor.

This facility plans to provide Incidental Medical Services – IMS. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. A Plan of Operation that includes IMS must be submitted to the Department. A review of staff records on today indicates individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Applicant was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Huimin understands that there shall be at least one person, with valid CPR and First Aid certifications, on site at all times or present during off-site activities.

LPA discussed the water test of lead requirement on PIN 21-21-CCP regarding Assembly Bill (AB) 2370 requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test.

LPA discussed the requirements of AB 633 to Applicant Representative, Huimin Xu and provided her the fact sheet and she understands the requirements.

LPA conducted an exit interview with Huimin Xu and advised her that a license for 40 preschool children is now pending upon management's final review and approval.
