Licensing Program Analysts (LPAs) Dung Mac and Marilou Monico, conducted an announced pre-licensing inspection to the Facility today. LPAs met with Jetalben Patel, Applicant Representative/Site Director, and explained the nature of today's inspection to them. The Facility is still in operation (Facility #434406741) pending the approval of the change of ownership. Note: Applicant Representative has applied for an Infant (#434417024) and Preschool (#434417023) on the same premises.

The Infant Center will operate Monday through Friday from 8:00AM to 6:00PM, serving Infant children ages 6 months – 24 months. The Infant program will be using Infant Room and the Preschool program will be utilizing Toddler/Preschool and Preschool/Pre-K Rooms.

A fire clearance approval from the San Jose Fire Department for 10 Infant children was received prior to today's inspection. LPAs toured and measured the indoor and outdoor areas of the facility during today's inspection.

INDOOR ACTIVITY SPACE:
(16.250 x 16.250) + (1.750 x 3.500) - (encumbered) (4.000 x 6.250)
= (64.062 + 6.125 ) - 25.000 = 245.187

TOTAL INFANT INDOOR SPACE = 245.187 sq. ft. divided by 35 = 7 children

Since the indoor space is only measured for 7 children, a revised application for a child care center license was submitted during the inspection.

The Infant Room has a refrigerator. Feeding chairs and other appropriate seating equipment will be used to seat infants during feeding. Jetalben Patel understands that propped bottles are not permitted. Infants shall be held during feedings if they are unable to sit unassisted. Jetalben Patel understands that the Needs and Service Plan needs to be updated at least once every 3 months. A baby walker or any similar items shall not be used on the premise of a child day care facility.

Sleeping area is separate from the indoor activity space. Facility has 4 cribs, 9 high chairs, 1 feeding chair, and 6 mats for older infants. There is also a child size toilet in room with changing table. There is an appropriate changing table that has raised side (3 inches in height) and is within an arm's reach of a sink and the changing pad is at least one inch thick. LPAs observed containers with tight-fitting lids for solid waste and diaper disposable. Sick children will be isolated in the director's office and isolation equipment will be provided. Jetalben Patel states that there are no weapons or firearms on the premises.

Jetalben Patel understands that cribs shall be arranged to provide a walkway between cribs to allow staff to reach each infant without having to reach over any other infants. Jetalben Patel understands that each infant's bedding shall be used for him/her only and such bedding shall be replaced when wet or soiled. Jetalben Patel also understands that the infants must be under direct visual supervision at all times, including nap times, in the separate sleeping (crib) area.

There are one table, 12 chairs, and 10 cubbies. Facility has appropriate lighting in classroom. Functioning smoke/carbon monoxide detectors were observed. Facility has adequate toys and activities for children. Medications will be stored in Director's office. First aid supplies (including touch less thermometer) will be stored in the locked cabinet in the bathroom. Cleaning supplies will be stored in a locked cabinet in the kitchen.

There are one sink and one toilet available for older infant children to use. The sink used by children only have cold running water. Jetalben Patel states that the Infant program will offer potty training. Drinking water will be readily available for the children both indoors and outdoors via individual sippy cups and bottles. Transportation will not be provided by the Facility.

Parents will provide formulas, baby food, diapers for young infant children. Facility will provide AM/PM snacks for older infants. There is an off-limits kitchen for food preparation. The food preparation area (kitchen) is functional and has hot and cold running water, sink, refrigerator, oven, microwave, dish washer, and storage spaces for food. Disposable utensils and plates will be utilized by the Facility.

OUTDOOR MEASUREMENTS ARE AS FOLLOWS:

(35.500 x 24.000) - (encumbered) ( 6.500 x 10.667) + (3.417 x 3.667)
= 852 - 81.865 = 770.135

TOTAL OUTDOOR SPACE = 770.135 sq. ft. divided by 75 = 10 infant children

LPAs observed the infant playground does not have fence (at least 4 feet high) to separate the yard from the preschool playground and fence from the infant program's main entrance. LPAs observed air conditioning unit has a fence around it and a locked shed. There is a ground pool on the preschool playground. Pool has at least 5' high fence and can be seen through. Pool has a wrought iron fence and both gates swing away from the pool, self-close, and self-latching. Gate handles lock from the outside only. Space between bars on fence is no more than 4 inches apart. Bottom of fence is less than 4 inches from the ground. LPAs observed 2 windows in off-limit garage have direct access to the pool.

Jetalben Patel, Applicant Representative/Site Director, has obtained a Criminal Records Clearance and Child Abuse Index Checks. Director has met the education and experience qualification requirements and her Pediatric First Aid/CPR Certifications expire 9/11/2023. Director has proof of completion of Preventative Health Practices and proof of immunity against Measles and Pertussis, Influenza on file.

Safe Sleep Regulations were discussed. Jetalben Patel was provided with a copy of the Safe Sleep Regulations (PIN 20-24-CCP).

LPAs reminded Jetalben Patel of the applicable civil penalties for those adults who have not received fingerprint clearances, are not associated to the facility, and who come in contact with or provide care and supervision to the children. For an initial violation, civil penalty amounts to $100.00 per person per day up to $500.00 per person. For a subsequent violation within a 12-month period, civil penalty amounts to $100.00 per person up to $3000.00 per person.

Incidental Medical Services (IMS) policy. This facility plans to provide Incidental Medical Services – IMS. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. LPAs conducted an exit Interview and advised Jetalben Patel that a license for 7 children in the infant program will be approved pending the receipt of the following items:
1) Resilient materials to absorb falls under and around the sliding structures.
2) Fence (at least 4 feet high) to separate the infant yard from the preschool yard and fence from the infant program's main entrance.
3) Revised fire clearance for 7 children
4) At least 5 foot fence to be installed in the area of the swimming outside the windows facing the swimming pool.
