Licensing Program Analysts (LPAs) Joe Macias and Farida Raja conducted an unannounced Case Management Inspection. The LPAs were greeted and granted entrance by the Licensee Elizabeth Gonzalez. The purpose of today’s inspection is to ensure the home is in compliance with Title 22 California Code of Regulations. Also present during today's inspection was the Licensee's assistant who is cleared and associated to the facility license. Todays census is 14, (3 infants, 11 preschool age). The current census places the Licensee out of Ratio.

This is the second time the Licensee has been over ratio in the last 12 months. The Licensee was cited a type A citation on February 3, 2023 for the number of children present. As a result of today's inspection the Licensee will be cited a type A citation, as well as be issued civil penalties.

For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either:
- Twelve children, no more than four of whom may be infants.

A large family day care home may provide care for more than 12 children and up to and including 14 children, if all of the following conditions are met:
- At least one child is enrolled in and attending kindergarten or elementary school and a second child is at least six years of age.
- No more than three infants are cared for during any time when more than 12 children are being cared for.
-The licensee notifies a parent that the facility is caring for two additional schoolage children and that there may be up to 13 or 14 children in the home at one time.
These conditions were not met, therefore the Licensee is out of compliance.

Type A deficiency cited, civil penalty assessed. Exit interview conducted and report was reviewed with the Licensee Elizabeth Gonzalez.

A notice of site visit was given and must remain posted for 30 days.

Child Care Parent Notification Requirements and Acknowledgement of Receipt of Licensing Reports (LIC9224) was also explained and provided to Licensee during today’s Inspection.

The Licensee will be subject to additional visits to ensure that she is within capacity requirements for a large FCCH. She will submit schedule of children enrolled that demonstrates how ratio will be maintained each day by 2/17/2023.

Upon arrival to the family child care home (FCCH), LPA's observed 14 children in care (3 infants and 11 preschool-age), which poses an immediate threat to the health, safety, and personal rights of children in care.

LIC9224 must be signed by all parents currently enrolled and submitted to Licensing by end of day 2/15/2024. LIC9224 and LIC809 and 809D must be provided to all future enrollments for the next 12 months and maintained in file.
