32 | C2’s parent said that she has never observed S1 yelling and she thinks S1 just speaks loudly. S1 was interviewed and recalled saying something like “Wow, are you okay?” but not yelling. The LPA finds that even if S1 had yelled out it would not constitute a violation because the statement was an exclamation and not derogatory or intimidating. The allegation was not corroborated through interviews, records or observation. A copy of C2’s behaviors and C2’s contact information was provided by the facility and did not corroborate the allegation.
Based on available information at this time, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. This report was reviewed and discussed with the licensee. Appeal Rights were provided. Notice of Site Visit shall be posted for 30 days from today’s visit. |
