13 | The Licensing Program Analyst (LPA) Snow met with Susan Miller to conduct and unannounced inspection to deliver the investigation findings. It had been alleged that staff hit a daycare child; specifically hitting Child (C-1) across the face with no injury reported. Also alleged is staff handled C-1 in a rough manner resulting in injury; specifically causing a large bruise on the leg. The LPA toured the facility with the Director/Susan who denied the allegations on 5/21/19 at 10:45 am stating that she is not aware of any staff hitting or handling children roughly, she was aware of the bruise on C-1’s leg but said that staff did not grab the child or cause a bruise.
The LPA interviewed 8 staff 5 of whom work or worked in C-1’s classroom; they did not observe rough handling and did not corroborate the allegation. The LPA interviewed C-1 who did not corroborate the allegation. The LPA conducted interviews with 4 other children from the same classroom whom did not corroborate the allegation. The LPA(s) did not see any hitting or rough handling during the three unannounced investigation visits conducted on 5/21/19 & 6/5/19 & 6/26/19. A copy of the roster and pertinent documents from the Child's file were received from the facility on 5/21/19. The LPA contacted CPS, Local Police and they provided no information that would corroborate the allegations. The LPA received a copy of the medical report regarding C-1’s bruise and no abuse could be corroborated. Based on available information at this time, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. This report was reviewed and discussed with the licensee. Appeal Rights were provided. Notice of Site Visit shall be posted for 30 days from today’s visit. |
