25 | On 11/1/23 @ 11:30am, a visit was conducted by Licensing Program Analyst (LPA) N. Cunningham in response to an unusual incident that was self reported in a timely manner by Michelle Sturr, site supervisor. The incident occurred on 10/26/23 at approximately 11:20am. Community Care Licensing Division (CCLD) was notified within 24 hours and unusual incident report was sent in writing within the 7 days as required. Facility director reported that a teacher (Staff 1) miscounted the children when they transitioned from outside play to the classroom. Child 1 stayed outside while the other children and staff went into the classroom. Child 1 was unsupervised on the playground for approximately six minutes. Staff 1 found Child 1 playing outside close to the classroom door. During today's inspection, LPA reviewed video footage of the incident and toured inside and outside areas. LPA photographed the area Child 1 was at when they were unsupervised and noted that Child 1 was in an enclosed area and was unable to exit the area.
The following violation of the California Code of Regulations, Tittle 22: Division 12 was observed: Lack of supervision resulting in a child wandering outside. see LIC 809D.
Exit interview conducted and report was reviewed with the site supervisor. A notice of site visit was given and must remain posted for 30 days. Appeal rights were provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
