32 | LPA Wheeler interviewed Danielle Tuttle (S1), Head Teacher/Supervisor in classroom C at 10AM on 6/02/23. During the interview Ms. Tuttle confirmed the allegation stating that after she returned from a lunch break, she took a head count and realized a child (C1) was missing from the playground. A staff person from another classroom (S3) found the child outside the gate to the playground and stayed with the child until Ms. Tuttle and staff were able to locate the child. Ms. Tuttle and other interviewees (S2, S3, P1, P3, P4, P5, P6) stated that parents tend to leave gates open or unlocked as they come and go from the facility. Ms. Tuttle stated that there was an incident report created but not by her and she never saw said incident report. Nine staff (S1 – S3) and parents (P1 – P6) were interviewed from 5/9/23 to 6/2/23 corroborating the allegation. S2 stated that they were outside supervising children in the sandbox, when S1 asked “Where’s C1”, S2 noticed gate was open and that C1 was missing. S3 during pick up time for their class, he noticed C1 asking parents of S3’s class if they could take C1 home. S3 waited with C1 until S1 and S2 found them. P5 stated that, “Several kids who have special needs/extra help are let down by Head Start staff.”
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
LPA J. Helton informed facility representative Leigh Lemke that this report dated 6/21/23 documents 1 Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA J. Helton informed the facility representative to provide a copy of this licensing report dated 6/21/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
