32 | It has been alleged that staff failed to keep facility free from mold. LPA Pacheco met with the licensee on 06/07/19 and discussed the allegation. The licensee stated that there are was an issue with some water leaking in on one of the perimeter walls during the winter rains, but that it was repaired and that there is no mold in the building. During the course of the investigation, the facility was toured both inside and outside, including all areas accessible to the children. LPAs observed that there was no noticeable mold in the facility. Staff and witness interviews were conducted and it was corroborated that there has not been any evidence of mold noticed anywhere in the facility, including the wall which had leaked during months with rain. Based on the information available, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred and the findings are unsubstantiated.

The licensee stated that they have had some water bugs but they have a pest control company that is called when needed and that they have mouse traps in the inaccessible kitchen area as a preventative measure but have not had any issues with vermin entering the building. During previous inspections conducted on 06/07/19, 06/10/19 and 08/01/19, the facility was toured both inside and outside. It was observed that there was no evidence of any pests in the facility. Staff interviews were conducted, and it was corroborated that water bugs have been seen during the rainy season but were removed immediately and that there have not been any vermin observed in the facility. Witness and children were interviewed, and it was corroborated that there have not been any vermin or insects observed in the facility. Based on the information available, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred and the findings are unsubstantiated.
It has been alleged that staff failed to maintain a comfortable room temperature for day care children LPA Pacheco met with the licensee on 06/07/19 and discussed the allegation. The licensee stated that in the thermostat is always set at a temperature that is within the regulated window of allowable temperatures. During previous inspections conducted on 06/07/19, 06/10/19 and 08/01/19, the temperature in the preschool rooms was measured and observed to be within the regulation requirements. Staff and witness interviews were conducted and it was corroborated that even on days with extremely high temperatures, the staff ensures that the air conditioner is turned on early to ensure that the preschool rooms are maintained at a comfortable temperature. Based on the information available, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred and the findings are unsubstantiated.
