On 11/15/2023, at 1:30pm, a complaint investigation visit was made to the facility by Licensing Program Analyst (LPA) Cunningham. It has been alleged staff inappropriately disciplined daycare child; specifically, Staff 1 restrained Child 1 (approximately 1 ½ years old) by placing their leg over Child 1 for approximately two minutes. Community Care Licensing obtained a photo of the alleged incident. On 11/6/23, the director self-reported that Staff 1 restrained Child 1 and Staff 1 was issued a disciplinary notice for the incident. The director provided LPA with a copy of the disciplinary notice. During today’s inspection, LPA interviewed the director and five staff (Staff 1-5). Staff 1 stated they restrained Child 1 because Child 1 was in timeout and to keep them from touching other babies in the classroom. Staff 2 and Staff 5 reported observing the incident. Staff 2 and 4 viewed the photograph of the incident and confirmed Staff 1 placed their leg over Child 1.

Based on the director and staff statements, the preponderance of evidence standard has been met; therefore, the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.

LPA Cunningham informed licensee to provide a copy of this licensing report dated 11/15/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.



Exit interview conducted and report was reviewed with the licensee. A notice of site visit was given and must remain posted for 30 days. Appeal rights were provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

The director stated she informed Staff 1 that staff are not able to physically restrain a child unless said child is in immediate danger. The director provided proof of the conversation.

On 11/15/2023, at 1:30pm, a complaint investigation visit was made to the facility by Licensing Program Analyst (LPA) Cunningham. It has been alleged staff spoke inappropriately to daycare child; specifically, Staff 1 spoke inappropriately to Child 1. During today’s inspection, LPA interviewed the director and five staff (Staff 1-5). Staff 1 stated they spoke firmly to Child 1 but did not raise their voice or say anything inappropriate. Staff 2 and Staff 5 reported observing Staff 1 speak to Child 1 and did not disclose a concern of the way Staff 1 communicates with children. Staff 2-5 reported that Staff 1 interacts with well with infants and has a lot of patience. During today's inspection, LPA observed Staff 1 communicating with three infants in an appropriate manner. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.
