Licensing Program Analyst (LPA) N. Cunningham conducted a subsequent inspection to deliver the finding regarding the allegations mentioned above and met with Licensee Angel-Schmitz. LPA Cunningham previously met with Licensee Angel-Schmitz on 02/08/22 and 02/11/22 to discuss the allegation. It was alleged that the licensee restrained a day care child in a car seat. The licensee admittedly denied the allegation.

Through the course of the investigation, starting from 02/08/2022 through 05/02/2022, LPA interviewed the licensee and seven witnesses. LPA was unable to interview children because they were not verbal, too young to interview, not available, or did not qualify to be interviewed. During LPAs three inspections, LPA did not observe a child restrained in a car carrier.

One witness reported that the licensee restrains children in a car carrier for an extended period of time. One witness reported that they observed a child in a car carrier for approximately 2-5 minutes. Five witnesses reported that they have never observed the licensee restrain a child in a car carrier or similar device.

Although the allegation may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, and the findings are unsubstantiated. Appeal rights were provided, and an exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
