On June 14 at 1:00pm, Licensing Program Analyst (LPA) N. Cunningham conducted an unannounced complaint inspection, and met with licensee Angel-Schmitz. It was alleged that an assistant under 14 was providing care and supervision, the licensee restrained day care children in a car seat, the licensee is physically rough with children in care, and the licensee is not providing adequate meals to children in care.

The licensee was interviewed on March 3, 2023 at 9:00am and denied all of the allegations. The licensee emphasized that she is always cooking and frequently sends food home with parents.

Four witnesses were interviewed during the investigation. Interviews revealed that an assistant under 14 was consistently providing care and supervision to daycare children. Interviews also corroborated that the licensee restrained a daycare child in a car seat, the licensee was physically rough with daycare children, and the licensee was not providing adequate meals. The allegations were also corroborated by reports from multiple agencies.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, (Title 22), are being cited on the attached LIC 9099D. Appeal rights were provided. o

LPA Cunningham informed licensee to provide a copy of this licensing report dated 6/14/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Licensee Angel-Schmitz.
