Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint investigation visit with facility representative for the purpose of delivering complaint investigation findings. LPA previously met with Center Director to discuss the purpose of the visit and to request; facility roster ( LIC 9040), staff schedules and contact numbers, Children sign in/ out for the month of January 2023. It has been alleged staff yell at children in care.
During the initial investigation an interview was conducted with Center director and six staff members on 02/08/23. Center director reported staff do not yell at children. Some staff corroborated center director’s statement adding they had not seen or heard staff yell at day care children. One staff member reported they had heard another staff member speak in a loud voice towards the children. Another staff member reported they didn’t know if they heard staff yell at children but maybe it’s their voice and approach to the children. The staff reported when they hear staff raising their voice, they have spoke to the staff and brought it to their attention. Another staff member reported there was one staff whose voice wasn’t too loud or too soft but just the right level of noise for the children. Continued on 9099-C

Interviews were conducted with five guardians between 03/29/23 and 04/12/23. One guardian reported that teachers raise their voice to get children’s attention and it can look like yelling from a parent’s perspective if they don’t know the situation. Another guardian reported they would arrive to pick up their child at random times and enter the room and never heard any staff yelling at children. All guardians expressed they have no concerns about any staff members yelling at children in care. Interviews corroborated guardians did not hear staff yell at day care children.

Based on interviews conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated. This report was reviewed and discussed with facility representative, She was provided with a copy of this CIR; and Appeal Rights. All licensing reports are public information and must be made available upon request for at least three years.

There were no Title 22 deficiencies cited during today’s inspection.
