32 | Interviews were conducted with four parents and three children on 02/16/22 an 05/02/22. Most parents expressed they have no concerns about the safety of their children. Parents stated licensee and staff will call parents if a serious injury occurs, but most of the time it is children fighting over a toy, not sharing or the child tripping. Parents reported they felt it was adequate for licensee and staff to report any incident as those previously stated at parent pick up time. Parents also reported, licensee and staff use time out as discipline when children are not getting along. One parent reported C1 was having issues with sharing, and they would push children to keep the object. Parent stated licensee and staff have since been able to help teach C1 to share and use their words instead of physical action. Another parent reported C2 will tell them all the incidents that have occurred throughout the day at the day care. The only item they reported on 01/26/2022 was C3’s return to the daycare, and the activities they did for the day. On 02/16/2022, C2 reported C1 had pushed both C2 and C3 before but it doesn’t happen often, and when it does occur C2 tells staff member, and staff member will place C1 on time out. C2 didn’t mention another occurrence of child on child injury. Other children interviewed didn’t report any occurrence of injuries happening, they only replied when friends get hurt, they receive help from licensee and staff.
On 05/03/2022, LPA Hernandez Torres arrived to the facility to observe children interactions and staff child ratio. There was one staff supervising four preschool aged children, C1, C2, C4, C5. Staff member was able to teach C1 and C2 while C4 and C5 were having independent play. When C4 and C5 were beginning to get rowdy or appear to fight for the same toy, staff member was able to go over and settle the two children, reminding them verbally to share and to separate from each other. The children responded to her request and kept playing without an altercation. In another instance, staff member was helping C5 get ready to go outside, when C2 began to provoke C4, and staff member didn’t notice. Once staff member turned her attention to the other children, C2 moved away from C4 and left him alone.
Based on interviews conducted, records reviewed, and observations, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated. This report was reviewed and discussed with Licensee, She was provided with a copy of this CIR; and Appeal Rights.
