Due to the COVID-19 public health emergency, an announced tele-visit was conducted by Licensing Program Analyst J. Velasco (LPA), who met with director Alicia Wright (D1) to deliver investigation findings. It was alleged that the facility was in disrepair; specifically, that the air conditioner was not working, resulting in the facility not being a comfortable temperature for children in care and a child (C1) and other children being hot and sweaty. The complaint also states parents were not notified of the broken air conditioner and resulting uncomfortable temperature in the facility. D1 denied the allegation and reported that the air conditioner did break but was repaired in a timely manner and that staff used fans and portable air conditioners to keep children comfortable. D1 stated parents were notified of the broken air conditioner. On 08/24/2020, LPA conducted an initial complaint investigation inspection via tele-visit due to Covid 19 public health emergency. During this investigation, LPA reviewed facility documents and interviewed witnesses. Beginning at 10:00 a.m. on 08/24/2020, LPA interviewed one witness (D1). Beginning at 8:43 a.m. on 12/09/2020, LPA interviewed four witnesses (A2, A3, S1, S3). LPA made multiple attempts to interview other witnesses on 08/24/2020, 08/25/2020, and 12/09/2020.

Witness statements and documents failed to corroborate that the facility was in disrepair. Though documents and witness statements corroborate the fact of the air conditioner having been broken, a preponderance of the evidence did not corroborate that the facility was an uncomfortable temperature or that the staff failed to have the air conditioner repaired in a timely manner or that staff did not notify parents.
Based on interviews conducted and records reviewed, although the allegation may have happened or be valid, there is not a preponderance of the evidence to prove that the alleged violation occurred; therefore, the allegation is unsubstantiated. Appeal rights were provided. This report was read and reviewed with D1, whose original signatures were not recorded on this report. D1 was provided with a copy of the LIC9099 Complaint Investigation Report (CIR) and Appeal Rights in an email dated 12/10/2020 and confirmation of read receipt of the CIR is on file. All licensing reports are public information and must be made available upon request for at least three years. There were no Title 22 deficiencies cited during today's inspection.
