Licensing Program Analysts (LPAs) Elpidia Hernandez Torres and Melchisedeck Augustin conducted a subsequent complaint investigation visit with licensee, Gloria Linnear, for the purpose of delivering complaint investigation findings. LPAs previously met on 07/01/2021 to initiate the complaint investigation. It was alleged that staff did not provide timely medical care to day care child, staff did not inform authorized representative of incident timely, and staff hit day care child. Specifically, in the summer of 2020, the staff took daycare children to the park and while there a daycare child passed out but the child’s representative wasn’t informed of the incident until pick up time. Also alleged was that at some time later in the same month, staff had taken a different daycare child to the store where they allegedly hit child on the arm.

During the investigation interviews were conducted on 07/01/2021, 07/08/2021, 10/08/2021, and 10/15/2021 with, licensee, facility manager, four children, six adults and staff from the Resource and Referral agency. On 07/01/2021 at 01:25 PM, facility manager and licensee denied the allegations. Both Licensee and facility manager stated they take the children to the park but don’t recall a child fainting. Both stated if a child was to faint, they would call 911. Both stated there is no hitting going on in the daycare, and no child has been hit. Continued on 9099-C

Interviews notated that facility manager will take children to the store, or gas station for slurpees or to run errands. Interviews reported not all children get to go depending on the child’s behavior or room in the car. While on those outings no child reported being hit, or remember seeing another child get hit. Interviews revealed, the form of discipline at the daycare are time outs.

Four parent interviews conducted on 10/15/2021 revealed that facility manager would take children out to get a treat or run errands. Some parents stated they were notified at drop off or given a call beforehand to ask if it was ok to take a child out to run errands. Parents interviews corroborated that either facility manager or licensee would take children to the park but were not notified of any injuries occurring while on the outings. Some parents stated their children had mentioned other children getting hurt at the daycare but didn’t pay attention to the details or didn’t believe the children. Parents also, stated if their child had gotten hurt or injured they were notified verbally at time of pick-up and not typically at the time of the incident. Parents couldn’t confirm if the incidents required medical attention.

Based on interviews conducted and records reviewed, there is not sufficient evidence to confirm when the alleged incident occurred or what injury was sustained and if it required medical attention or timely parent notification. In addition, some parent’s statements reported concerns of their child either getting hit or obtained knowledge of a child getting hit those statements were not corroborated. Therefore, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the alleged violations occurred, therefore the allegations are Unsubstantiated.

This report was reviewed and discussed with Licensee who was provided with a copy of this CIR; and Appeal Rights. All licensing reports are public information and must be made available upon request for at least three years.
