Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint investigation visit with Center director for the purpose of delivering complaint investigation findings. It has been alleged Lack of staff supervision resulted in injuries to day care child.

During the initial investigation an interview was conducted with center director, four staff, and two children on 05/18/2023. Center Director reported all staff in all classrooms report incidents on the ‘Procare’ app used by the guardians. Staff members corroborated the center directors’ statements, reporting when an incident occurs, they write up what they saw and input it into the app. Staff interviews revealed when children are injured, staff will go to the child and assess the situation apply first aid when its required then either write the incident in the app or call the guardian depending on the severity of the incident.

 Children interviews revealed when they get hurt, they receive ice packs from the teachers. Children interviews corroborated who the staff are in the classroom, and how they are tended to when an injury occurs.

Interviews were conducted with five guardians from 05/17- 08/17. All guardian interviews revealed their children have gotten injured or hurt while at the preschool. Some guardians reported their child getting injured was due to their children being clumsy and they were typically the child falling or bumping into other children. Some guardian interviews revealed they are usually told in person or through the app when their children have gotten injured. A guardian interview revealed their child was injured, but the center was not able to identify how the child got injured as staff had told different stories. Some guardians were not able to remember who the exact staff members were in the classroom, but believed their child was injured of their own accord not due to lack of supervision.

Based on interviews conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated. This report was reviewed and discussed with Center Director, She was provided with a copy of this CIR; and Appeal Rights. All licensing reports are public information and must be made available upon request for at least three years.

Licensing Program Analyst (LPA), Elpidia Hernandez Torres, conducted a subsequent complaint investigation inspection on 08/17/2023 at 09:30AM for the purpose of delivering the findings regarding the above allegation. LPA previously met with center director on 05/18/2023 to discuss the purpose of the visit request children roster, interview children and make observations. It was alleged that authorized representatives are not allowed to enter or inspect the facility.

During the course of the investigation, interviews were conducted with center director, four staff, and two children on 05/18/2023. The center director reported there was one occasion where a family relative arrived to pick up a child and they couldn’t enter because the door was locked but then they went to another door was able to pick up from there. One staff member reported when guardians arrive they politely ask them to wait outside due to covid and per the sign that was posted at the door.

A staff interview revealed they were told by another staff member that guardians have to wait outside. Another staff reported guardians don’t just enter the room, they will enter if it’s a special event. Another staff interview revealed guardians are not allowed to enter the preschool and if a child is having a difficult time saying good bye they will walk the child to the window to wave to the guardian good bye, but has told the guardian they are not allowed to enter. Another staff reported they meet the guardian at the door with the child at pick up and drop off.

Five guardians were interviewed between 05/17 and 08/17. Interviews revealed, guardians line up outside during pick up and drop off. One interview revealed, a guardian was told by a staff member they aren’t allowed to enter the classroom. Another guardian interview revealed earlier in the year they were denied entry into the classroom, but it got better during the summer time. Another interview revealed they arrive and drop off the child but don’t go inside because its implied that guardians stay outside.

When LPA Hernandez Torres arrive to the facility on 05/18/2023, there was a sign on each door that had a stop sign printed on it and read “ DO NOT ENTER THE FACILITY Due to COVID-19 Only Authorized Employees Are Allowed to Enter Building”. LPA reviewed parents rights with Center Director and Center Director removed all three signs before LPA left the center.

Based on interviews, and observations, the preponderance of evidence standard has been met and the above allegation is found to be substantiated. The California Health and Safety Code, 1596.857 is being cited on attached LIC 9099D . This report was reviewed with the center director and an exit interview was conducted. Signature was recorded on this Complaint Investigation Report (CIR), a copy was provided. Notice of Site Visit shall be posted for 30 days. Appeal Rights were provided.

Center Director agreed to remove the sings from the doors, and to have conduct a meetting with all staff on parents rights. Center director will submit proof of meeting and staff attended via email, mail or fax to LPA.
