25 | Licensing Program Analyst (LPA), Melchisedeck Augustin made an unannounced Plan of Correction (POC) visit in follow up to an overdue POC. On 07/13/2022, the facility was cited a type B deficiency for violation of children's person rights as a result of substantiated complaint finding. On 07/13/22, the Licensee (LS) stated she would research the definition and topics related to Personal Rights, and LS agreed to produce an agenda relating to the topic, train staff, and submit a copy of the agenda to the Department by 07/27/22, however; the Department had not received the facility's POC. On 07/29/22, LS submitted AB 1207 Mandated Reporter Training certificates for LS and S1, and this deficiency was cleared, and LPA provided LS with a Letter of Deficiency Citations Cleared.
During today's inspection, LPA observed seven children in care and LPA did not observe any violation of children's personal rights. LS stated she had not produced a written statement/agenda which defined Personal Rights, LS did not conduct all staff training to discuss personal rights, as well as LS did not have and did not furnish a POC to LPA during the visit. LPA discussed with LS the importance of training staff on Personal Rights and submitting the facility's POC by the POC due date. In accordance with California Code of Regulations (CCR), 101195(f), the Department is assessing a Civil Penalty of $100 per day for period of 07/28/2022 through 08/01/2022 because the Licensee did not correct the deficiency by the date specified in the notice of deficiency.
Exit interview conducted, and report was reviewed with the Licensee. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were provided. |
