An unannounced follow-up complaint investigation visit was made today by Licensing Program Analyst (LPA), Y. Yang to deliver complaint investigation findings. Previous investigation visits were made to the facility by the LPA on 08/11/21 and 08/18/21. It was alleged that the facility is operating out of ratio and that staff are forcing infants to stay awake. Specifically, it was alleged that staff are forcing infants to stay awake until a designated nap time.

The LPA met with the facility licensee, Penny Bowers today at 11:20am to discuss the investigation findings. A follow-up tour of the facility was conducted at 11:30am today. There were 9 infants present at the facility; the appropriate ratios were being followed. During the LPA’s initial visit to the facility on 08/11/2021, the LPA met with licensee Bowers (staff S1) at 01:27pm to discuss the allegations. The licensee denied the allegations and stated that the facility always operates within ratio. The licensee stated that the only time more than four infants are supervised by one staff member is when the infants are napping in their cribs. The licensee stated that a ratio of up to 12 infants to one staff member may be used. The licensee stated that additional staff members are available on site to accommodate infants that wake up. The licensee stated that infants in care are permitted to nap whenever they choose. The licensee stated that infants under 12 months of age do not follow any nap schedule.

Interviews with facility staff were conducted during the investigation. Staff members S2-S5 were interviewed on 08/11/21 beginning at 02:06pm and S6 was interviewed on 08/18/21 at 12:23pm. Staff that were interviewed all corroborated the licensee’s statements. Staff interviewed all stated that infants in care are never forced to stay awake. Staff interviewed all described to the investigating LPA the supervision ratio the center follows for awake and napping children. Staff interviewed stated that they have not observed any instances where an infant classroom was out of ratio.

During the initial investigation visit, a facility tour was provided by the licensee at 01:15pm. A subsequent inspection visit was made to the facility on 08/18/21 and a tour was provided by the licensee at 11:03am. During the tours of the facility, the LPA observed that the proper child to adult ratio was being followed at the center. The LPA observed infants napping in cribs and infants that were awake. The LPA did not observe any staff member forcing an infant to stay awake.

Based on available information and interviews conducted, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegations are unsubstantiated. All licensing reports are public information and must be made available upon request for at least three years. This report was read and reviewed with the facility’s licensee, Penny Bowers. There were no Title 22 deficiencies cited during today's inspection. Appeal rights were provided.
