Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint investigation visit with Licensee for the purpose of delivering complaint investigation findings. It has been alleged facility does not meet infant's personal care needs, specifically that guardians pick up infants with poopy diapers and put clothes on that are too small on infants.

During the initial investigation an interview was conducted with licensee, and four teachers on 05/12/2022. Licensee provided LPA with facility roster, infant room schedule, sign in/out for five days, infant feeding plan, and daily care log for five infants. Licensee and staff denied allegations. Licensee stated children are checked every 30 minutes and diapering is logged, feedings are logged too, and parents are required to bring three different clothes changes and a bunch of underwear if they are potty training. Staff corroborated infants are checked every 30 minutes for diapering and documented if they are changed. Staff also reported sometimes if an infant runs out of clean clothes to wear they will call the infants guardian and ask if its ok to put on spare clothes the facility has, and some guardians will say yes that’s fine, some will say no and they will drive clothes over, or say its fine if its close to pick up time and pick up the child with soiled clothes. Staff also reported they check infants diapers before pick up time so they go home with a dry diaper, but there has been a few instances where a child was dry before pick up and they walk out the facility and guardian walks back in to ask center to change their diaper. Staff corroborated this has happened a few times and they have obliged with changing the infants’ diapers. Staff stated the infants that typically run out of clean clothes are those who are potty training, and it is those same infants who typically soil their diapers as they are getting picked up. Staff corroborated to their knowledge they have not intentionally sent a child home with a soiled diaper or wrong size clothes. One staff stated they did accidentally place a child in their siblings’ clothes but it was an accident and they contacted the guardian to let them know of the mistake the following day.

Four guardians were interviewed on 05/31/2022, and 06/17/2022. All guardians stated they are required to bring extra clothes and diapers for their infants and are reminded at pick up time if infant is running low or needs more items. Some guardians stated their infant had been returned with clothes that was not theirs. One guardian corroborated that the center did call them a few times before when their child has run out of clean clothes, but they don’t have an issue with the facility placing back up clothes on the child. Another guardian reported their infant had been picked up with their sibling’s clothes on which was very small, and that staff apologized the next day. One guardian stated on a few occasions, they have picked up the infant, and the infant was soiled and they have walked infant back to the facility and asked they changed the infant’s diaper and center did change the infant’s diaper.

Based on interviews conducted and records reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated. This report was reviewed and discussed with Center Director, She was provided with a copy of this CIR; and Appeal Rights. All licensing reports are public information and must be made available upon request for at least three years.

There were no Title 22 deficiencies cited during today’s inspection.
