Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint tele-investigation video conference with center director Aly Bowers for the purpose of delivering complaint investigation findings. Due to COVID-19, the Department has suspended all field operations, and director has agreed to attend a Facetime call with LPA. It has been alleged that staff caused injury to child in care, specifically sprained a child’s wrist on 11/04/2020.

During the initial investigation an interview was conducted with Aly, and two teachers on 11/10/20 at 11:55 AM, Center director and teachers denied the allegations. Center Director stated she had not seen any of the teachers hurt a child. Staff members corroborated the center directors’ statements. A follow up tour was conducted today at 12:35PM, there were 23 children present with 4 staff, no personal rights violations were observed.

Interviews were conducted with six parents and three children on 03/03/21 starting at 01:15 PM. Parents all expressed they have no concerns about any staff members causing injury to children in care. Parents also stated center reaches out by phone call, email, and messaging app “Hi Momma” to let parents know how their children are doing, and if any injuries had occurred. Children all stated the center is fun, and teachers are nice. The children expressed they felt safe at the center and had not observed any teachers or the center director injuring any children. They all stated they have seen children fall and scrape their knees and bumping heads with each other while playing outside. They all stated the Center Director/ Teachers take care of the hurt children by putting band aids, ice packs, and giving hugs to comfort the hurt child.

Based on interviews conducted and records reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated.

Director’s signature was not recorded on this Complaint Investigation Report (CIR), however, this report was reviewed and discussed with Center Director, She was provided with a copy of this CIR; and Appeal Rights, Director’s signature will be on file. All licensing reports are public information and must be made available upon request for at least three years.

There were no Title 22 deficiencies cited during today's video inspection.
