32 | S1 stated that she informed C1 that she would notify S4, who was inside the adjacent classroom, and request assistance to have C1 changed. S1 stated that C1 then began having a temper tantrum and was on the ground flailing their arms and legs and throwing toys. S1 stated that S4 stepped into the playground to provide support. S1 stated that to protect the safety of the other children nearby, she picked C1 up and carried C1 to a nearby, composite wood bench on the other side of the playground fence. S1 stated that she placed C1 on the bench in order to close the playground gate behind her. S1 stated that C1 was still flailing and kicking as she placed C1 onto the bench. S1 stated that she then requested the assistance of C1’s guardian, who was on site at the time. S1 stated that she did not observe any scratches on C1’s leg at the time as C1 was wearing long pants. S1 stated that upon learning of an alleged scratch on the back of C1’s leg that same day, she inspected the alleged scratch and observed that it appeared to look more like a mark from playing on the playground rather than a scratch from the bench.
During the complaint investigation, staff interviews were conducted. Staff S1 was interviewed on 10/31/19 at 12:57pm. Staff S2, S3, and S4 were interviewed on 12/10/19 beginning at 01:58pm. S5 and S6 were interviewed on 12/20/19 beginning at 01:15pm. Interviews with staff S2-S6 did not provide any information to support that children at the facility are roughly handled or that inappropriate comments are made to daycare children. Staff interviewed all stated that they did not observe the alleged incident but provided character references for the center director.
During the investigation, child care clients and children were interviewed. Interviews with childcare clients did not provide corroborating evidence to support the allegations. The childcare clients that were interviewed all stated that they have not observed any personal right’s violations at the center. Children interviewed during the investigation did not provide corroborating information to suggest that they have been roughly handled while in care or that facility staff have made inappropriate statements to them.
