A follow-up unannounced complaint investigation visit was made to the facility by Licensing Program Analyst (LPA) Y. Yang to deliver complaint investigation findings. It was alleged that the facility is operating out of ratio and that facility staff failed to change children's soiled clothing resulting in rashes. Specifically, it was alleged that on the week of 06/24/19, child C1 and C2 attended the preschool during Vacation Bible School (VBS) week at the church on the premises and were not changed in a timely manner by preschool staff, resulting in diaper rashes. Further, it was alleged that there were instances during VBS week when one teacher was supervising over 30 children.

LPA met with the center director Mandy McCarthy (staff S1) on 07/08/19 at 02:05pm to discuss the allegations. The center director denied both allegations and stated that the preschool program always operates within ratio and that children at the preschool in soiled clothing or diapers are always changed in a timely manner. McCarthy stated that she was not present at the center during VBS week.

McCarthy stated that prior to taking the week off, she ensured there was adequate staffing at the preschool. McCarthy stated that on most days during VBS week, there were more teachers present at the preschool than required by Title 22 regulations. McCarthy stated that she is aware that there was at least one child present at VBS whose diaper or soiled clothing was not changed in a timely manner by VBS volunteers. McCarthy stated that VBS is a separate, one-week program operated by the church on the premises. McCarthy stated that VBS is open for enrollment to both children from Cross and Crown Preschool and children from the community. McCarthy stated that families are required to enroll and pay for VBS separately. McCarthy stated that several children who attended VBS were concurrently enrolled at the preschool. McCarthy stated that during VBS week, these children did not attend the preschool and were not under the responsibility of the preschool staff.

During the complaint investigation, interviews were conducted staff S1, S2, and S3 on 07/08/19 beginning at 01:40pm. Staff S4, S5, and S6 were interviewed on 08/21/19 beginning at 09:34am. Interviews with staff S2-S6 corroborated the statements of the center director. It was revealed during interviews that although child C1 and C2 are enrolled at Cross and Crown Preschool, C1 and C2 attended VBS at the church on the premises during the week of 06/24/19 and did not attend preschool this week and was not under the direct care and responsibility of the staff at Cross and Crown Preschool. Under the California Code of Regulations section 101158(a)(12), VBS at Cross and Crown Lutheran Church is exempt from licensure. Staff interviewed all stated that VBS is a separate program that is part of the church on site. Staff interviewed stated that VBS is operated by volunteers from the community and does not utilize staff from the preschool on the premises. Furthermore, it was corroborated through staff interviews that children at VBS and the preschool children were not commingled during VBS week.

During the investigation, child care clients and children were interviewed. Interviews with childcare clients did not corroborate that the facility has operated out of ratio at any time or that preschool children are not changed in a timely manner. LPA did not obtain any corroborating information from children that their soiled clothing was not changed in a timely manner.

Based on LPA’s observations on 07/08/19, LPA observed eight children being supervised by two teachers. During LPA’s follow-up visit to the facility on 08/21/19, there were no preschool children in care at the time of the visit. During today’s visit, LPA observed fifteen children being supervised by three staff members. The facility was operating within ratio during both times LPA was present when there were preschool children in care. In addition, LPA did not observe any preschool children in soiled clothing at the center. During the investigation, LPA reviewed the preschool’s attendance log for the week of 06/24/19. The log showed that on 06/24/19, there were a total of ten preschool children present. On 06/25/19, there were eight preschool children present. On 06/26/19, there were fourteen preschool children present. On 06/27/19, there were ten preschool children present. Finally, on 06/28/19, the log showed that there were six preschool children present at the center.

Based on available information, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are unsubstantiated.

All licensing reports are public information and must be made available upon request for at least three years. There were no Title 22 deficiencies cited during today's inspection. Appeal rights were provided.
