32 | During the course of the complaint investigation records were obtained on 04/23/20, 04/24/20 and 10/15/20 and interviews were conducted with 5 staff, Staff 2-Staff 6 (S2-S6), 1 adult, Adult 2 (A2) and 1 child, Child 2 (C2). Staff S2, S4, and S5 were interviewed on 05/05/20 beginning at 11:15am. S6 was interviewed on 05/06/20 beginning at 03:27pm. S3 was interviewed on 05/07/20 beginning at 09:38am. S2-S6 all denied the allegation that a facility staff hit a day care child. Staff interviewed all stated that all staff, including themselves, use the following techniques when working with the children in care: positive reinforcement to encourage desired behaviors, verbal reminders or hand gestures to communicate and redirect undesired behaviors, offering words to express feelings or problem solve, and lastly they may escort children to visit the Director in the office if additional support is needed. Interviews with C2 and A2 on 06/16/20 did not provide corroborating evidence to support the allegation. C2 stated that they have not observed any teachers hit a child on the hand and that all teachers are happy at school. A2 stated that the teachers at the school are always happy and dedicated and are always making sure that the children are learning.
Based on interviews conducted and records reviewed, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, therefore the allegation is unsubstantiated. Appeal rights were provided. This report was read and reviewed with the center’s Executive Director, Norma Ott, whose original signatures were not recorded on this report. Executive Director, Norma Ott was provided with a copy of the LIC9099 Complaint Investigation Report (CIR) and Appeal Rights in an email dated 10/30/20 and confirmation of read receipt of the CIR is on file. All licensing reports are public information and must be made available upon request for at least three years. There were no Title 22 deficiencies cited during today's inspection.
