32 | D1 gave an example of how inappropriate interactions are handled by staff, stating that on 04/30/21 an inappropriate interaction occurred were one child, Child 2 (C2) said something inappropriate about another child, Child 3 (C3) to Child 1 (C1), and it was handled following the Behavior Management guidelines outlined in both the Center Manual and Parent Handbook by issuing a Level Notice of Child Behavior for C2. D1 provided a copy of both the Center Manual and Parent Handbook to LPA Strother in an email on 05/10/21. D1 stated that she is not aware of one child repeatedly verbally harassing another child and no child has brought to her attention that such a behavior is occurring.
During the complaint investigation, telephone interviews were conducted with facility staff (S1-S6) on 05/13/21, 05/18/21, 05/19/21 and 06/01/21. The staff interviewed all corroborated the center director’s statements. Staff interviewed all stated that they handle inappropriate interactions between children by speaking directly to the children involved. Staff also corroborated that they communicate with one another verbally and with the use of a staff logbook, stating that the logbook is used so that staff who are not present when a behavior occurred, are made aware of inappropriate interactions among children in their absence. LPA reviewed staff logbook on 05/12/21 for dates 10/29/20 through 05/02/21. Staff interviewed corroborated that parents are notified of inappropriate behavior using Behavior Notices or Level Notices, corroborating that a Level Notice was issued to C2 on 04/30/21 when C2 said something inappropriate about classmate C3. LPA Strother obtained a copy of the Level Notice issued to C2 on 04/30/21 during the complaint investigation. Interviews with daycare children were conducted by the LPA during the investigation. Child 1 – Child 6 (C1-C6) were interviewed using FaceTime on 05/13/21 or 05/18/21. The children interviewed all stated that they have heard other children make inappropriate comments to others. C1-C6 corroborated that they witness staff speaking to children about inappropriate behavior when the behavior is witnessed by staff or when a child involved in an inappropriate interaction brings the behavior to the staff’s attention.
Although inappropriate interactions between daycare children may have occurred, based on information gathered during interviews and records reviewed, there was insufficient evidence to support that staff do not respond to inappropriate interactions. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. There were no Title 22 deficiencies cited during today's inspection. Appeal rights were provided. All licensing reports are public information and must be made available upon request for at least three years. This report was read and reviewed with the Center Director whose original signature was not recorded on this report. Center Director, Cristina Northcroft was provided with a copy of the LIC9099 Complaint Investigation Report (CIR) in an email dated 06/02/21 and confirmation of read receipt of the CIR is on file.
