A follow-up unannounced complaint investigation inspection was made to the facility by Licensing Program Analyst (LPA) Y. Yang. It has been alleged that there is a lack of supervision resulting in physical altercations between day-care children, that facility staff handled day care children in a rough manner, specifically that children are being aggressively grabbed by the waist, that the facility is operating out of ratio, specifically that there have been multiple instances where one staff member was supervising 30 children, and lastly, it was alleged that the facility is unsanitary, specifically that at an unknown date, trash was observed by the facility's front door.
On 05/07/19 at 03:30pm, LPA met with the center director (S1) to discuss the allegations. The center director denied the allegations and stated that children are always properly supervised while at the center. S1 stated that neither herself, nor any of the other staff members at the center have ever handled a day-care child in a rough manner or have grabbed a child aggressively by the waist. S1 stated that the school age classroom is always within ratio. S1 denied that the facility is unsanitary and that there was ever trash by the facility's front entrance. S1 stated that trash inside the center is collected daily and disposed of immediately.

A follow-up unannounced complaint investigation inspection was made to the facility by Licensing Program Analyst (LPA) Y. Yang. It has been alleged that the facility co mingles children in care; specifically, that children from the center's school age license are co mingled with children from the center's preschool license. Based on LPA's observations during multiple unannounced inspection visits to the facility, LPA observed two school age children present on 05/07/19 at 01:45pm, three school age children present on 06/18/19 at 11:43am, and four school age children present on 06/25/19 at 10:09am in the "Pre-K" classroom for non-planned activities with preschool age children. During these inspection visits, LPA observed appropriate staffing ratios being met during the co mingling.

During an interview with the center director (S1) on 05/07/19 at 03:30pm and the assistant director (S2) on 06/18/19 at 12:05pm, both S1 and S2 acknowledged that the center's school age children are being co mingled with the children from the "Pre-K" classroom for convenience due to a shortage of teachers at the center.

In combination programs, indoor activity space provided for school-age child care center children shall be physically separated from space provided for infant care and child care center children. This requirement was not met as evidenced by: based on LPA's observations, LPA observed two school age children present on 05/07/19 at 01:45pm, three school age children present on 06/18/19 at 11:43 am, and four school age children present on 06/25/19 at 10:09am in the "Pre-K" classroom for non-planned activities with preschool age children. This poses a potential risk to the children in care.

The assistant director stated that the center has indefinitely suspended the school age license until a school age teacher is hired by the center. The assistant director stated that she will notify CCLD once a school age teacher has been hired. This deficiency has been cleared during today's inspection visit.

During the investigation, interviews with several school age children were conducted. Children interviewed corroborated that they were co mingled with children from the preschool license for daylong, non-short term activities on more than one occasion.

The allegation that the facility co mingles children is substantiated. This report was read and reviewed with the assistant director.

The following violation of the California Code of Regulation, Title 22, Division 12, were observed; see LIC 9099-D. Appeal rights were provided. Type B deficiencies are defined as a potential Health and Safety risk to children in care. Notice of Site Visit must be posted for 30 days.

During the investigation, interviews were conducted with staff members S1, S3, S4, S5, and S6 on 05/07/19 beginning at 01:30pm. Staff members S2, S7, and S8 were interviewed on 06/18/19 beginning at 12:05pm. Staff were unable to corroborate the allegations that there is a lack of supervision resulting in altercations between day care children and that facility staff handled children in a rough manner. Staff interviewed all stated that children at the center are always properly supervised by a qualified staff member and within ratio. In addition, facility staff did not corroborate that the facility is unsanitary. Staff stated that they have not observed any trash by the facility's front entrance and that all solid waste is kept in trash cans with tight fitting lids at the center. Staff stated that the trash inside the classrooms are collected and disposed of at the end of each day.

During the course of the investigation, interviews with childcare clients and children were also conducted. LPA did not obtain corroborating information from child care clients or children to support the allegations.

During LPA's unannounced inspection visits to the facility on 05/07/19, 06/18/19 and 06/25/19, LPA observed adequate supervision being provided by staff members to the children in care. LPA did not observe any children being roughly handled by facility staff. LPA observed appropriate ratios being observed in the classrooms. LPA observed that garbage cans at the facility containing solid waste have tight fitting lids. LPA did not observe any loose garbage inside the classrooms or located on the premises of the child care center.

Based on available information, although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, therefore the allegations are unsubstantiated. Appeal rights were provided. This report was read and reviewed with the assistant director. Notice of site visit must be posted for 30 days from today's inspection date.
