32 | During the initial complaint investigation interview with director Richardson on 12/18/20, the director denied the allegations and stated that neither her nor any of C1’s teachers have observed or heard about C1 being kicked, injured, or targeted by other children in their class. The director stated that for a period, C1 along with several other school-age children engaged in friendly rough housing and wrestled with one another while in their classroom. The director stated that the rough housing was not directed at any particular child. The director stated that to address the issue of wrestling, changes were made in the classroom including spacing desks further apart to occupy free space, removing carpeting, and implementing a positive reinforcement reward system. The director stated that the changes significantly reduced the instances of rough housing inside the classroom. The director stated that school-age children at the center are always supervised while in care and any altercations and/or rough play between children is immediately broken up.
The director stated that neither her nor any of C1’s teachers have ever made any inappropriate statements towards C1. The director acknowledged that staff S2 however, did confirm to C1 that their toy elf was store bought when questioned about it by C1’s classmates. During an interview with staff S2 on 03/15/21 at 02:05pm, S2 stated that she never communicated to C1 that “The Elf” was fake. S2 stated that several of C1’s classmates stated that they had the same elf at home that their parent purchased from the store and asked her if C1’s elf was store bought as well. S2 stated that she confirmed that C1’s elf was purchased from the store as well but stated to the children that does not mean that elves are fictional.
During the complaint investigation, interviews were conducted with facility staff (S2-S5) on 03/15/21. The staff interviewed all corroborated the center director’s statements. Staff interviewed all stated that they have never observed any staff member failing to intervene in inappropriate behavior between children. The staff interviewed all stated that rough housing is not permitted at the center and is broken up immediately. The staff interviewed all stated that corporal and other forms of unusual punishment and intimidation is never used at the facility. Interviews with daycare children were conducted by the LPA during the investigation. The children interviewed all stated that they felt safe while attending the center and that they did not have any concerns about any staff member or their own safety while at the center. The children that were interviewed all stated that they have not heard any inappropriate statements being made by staff members.
Based on available information and interviews conducted, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegations are unsubstantiated. All licensing reports are public information and must be made available upon request for at least three years. This report was read and reviewed with the facility director. There were no Title 22 deficiencies cited during today's inspection. Appeal rights were provided.
