Licensing Program Analyst (LPA) N. Cunningham met with the Licensee to deliver complaint findings. The meeting was conducted via tele-inspection due to the current state of emergency regarding the COVID-19 outbreak. The facility was closed during this tele-visit. LPA met with the Licensee on 01/28/20 and 02/26/20 and discussed the allegations filed against the facility. It was alleged that unqualified staff were providing care to day care children; specifically, staff did not have required college units. During the investigation, the Licensee provided copies of college transcripts for 10 staff and a personnel report which list staff names and their job title. A review of Staff 3 and Staff 10’s college transcripts indicate they do not have the required units to be working as a teacher which is the position listed for the referenced staff on the personnel report. Interviews further confirm that these staff members worked in the capacity of child care teachers. It was also alleged that staff are not fingerprint cleared. On 02/26/20 at 1:30 p.m., LPA reviewed Facility Personnel Report dated 01/27/20 and 02/24/20, both reports indicated Staff 3 does not currently have a criminal record clearance. The Licensee promptly sent Staff 3 to get fingerprinted. In the future, the Licensee agrees to confirm staff are cleared and associated to the facility prior to working.

Staff 3 worked at the facility since 09/2019 without a criminal record clearance. This poses an immediate risk to children in care. A civil penalty in the amount of $500 was assessed.

Licensing Program Analyst (LPA) N. Cunningham met with the Licensee to deliver complaint findings. The meeting was conducted via tele-inspection due to the current state of emergency regarding the COVID-19 outbreak. LPA met with the Licensee on 01/28/20 and 02/26/20 and discussed the allegation filed against the facility. It was alleged that an underage staff (Staff 11) member is left alone with children in care. The Licensee denied the allegation and stated Staff 11 is never left alone with children. LPA conducted interviews with 9 staff; two staff stated they have observed Staff 11 supervise a group of children by themselves and seven staff stated they have never observed Staff 11 supervised a group of children on their own. Staff 11 stated they have never been left alone with children. Interviews conducted with staff, parents, and the Licensee does not provide enough evidence for LPA to determine if the allegation did or did not occur. Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, and the findings are unsubstantiated. An exit interview was conducted. There were no Title 22 deficiencies cited regarding this allegation. Appeal Rights were provided.

LPA a copy of the LiveScan paperwork she submitted along with her fingerprints. The LiveScan form did not include a facility number, therefore, Staff 3's criminal record clearance was not completed prior to working at the facility. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. A Civil Penalty in the amount of $500 was accessed for an individual working in a facility without a fingerprint clearance. The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 9099D. Appeal Rights were provided.

Reports citing Type A violations are to be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file.
