A follow-up unannounced complaint investigation inspection was made to the facility by Licensing Program Analyst (LPA) Y. Yang. It has been alleged that a child sustained injuries while in care and that staff failed to provide adequate supervision to daycare children. Specifically, it was alleged that on unspecified dates, child C1 had child-sized, hand print bruises on their body and a large bruise on their face that extended from their left tear duct to their right ear lobe. Further, it was alleged that on 07/30/19, child C1 was observed to have a scratch of unknown origin on their face at the time of pick up.
On 08/07/19 at 02:05pm, LPA met with licensee/center director Debbie Deas (staff S1) to discuss the allegations. Deas stated that she denies the allegation that staff failed to provide adequate supervision to daycare children but acknowledged that C1 did sustain minor injuries on several occasions while in care. Deas stated that C1’s injuries were not due to a lack of supervision. Deas stated that although the facility always operates within ratio and children in care are always supervised by at least one adult staff member, accidents and injuries still occur and can even go unnoticed. Deas stated that C1 is independent and does not cry or notify staff members when injured while at the center.

Deas stated that there are a total of three incidents involving C1, with the first incident documented on 06/13/19. Deas stated that on 06/13/19, C1’s parent notified center staff that a mark was observed on C1’s back. Deas stated that while C1 was at home, C1 reported to their parent that C1 was hit by C2 at the center. Deas stated that although center staff did not observe or have prior knowledge of the alleged incident between C1 and C2, Deas stated that the alleged incident is plausible as the center was working with C2 and C2’s parents on several of C2’s behavioral challenges. Deas stated that all staff members at the center were aware of C2’s behavioral challenges and maintained increased supervision of C2 when C2 was around other children. Deas stated that neither herself nor any center staff observed any bruise or mark on C1’s body with their own eyes. Deas stated that she did view a photo of the mark, which was provided by C1’s parent.

Deas stated that on 06/18/19, a subsequent incident occurred at the center that involved C1 and C2. Deas stated that the two children were playing on the playground when C2 pushed C1, causing C1 to collide with a fence and scraping their knee. Deas stated that first aid was applied to C1’s knee and C2 was redirected to a different activity in a different area of the center. Deas stated that this incident was observed by teacher S4, who was supervising the children on the playground.

Deas stated that on 07/23/19, at the time of afternoon pickup, C1’s parent notified center staff that a bruise was observed on C1’s cheek. Deas stated that prior to being notified by C1’s parent, neither herself nor any of the teachers present that day had knowledge of the bruise or the bruise’s origin. Deas stated that the bruise was “a dime or nickel shaped bruise…with a small, red spot underneath.” Deas stated that C1 indicated that C1 bumped into a metal table on the play yard. Deas stated that she believes the incident occurred when C1 was playing outside, right before naptime. Deas stated that since the weather was warm on 07/23/19, Deas believes that C1 returned to the classroom for nap time with rosy cheeks. Deas stated that C1’s rosy cheeks did not arouse suspicion or concern from staff. Deas stated that C1 then went down for naptime. Deas stated that upon waking up from naptime, C1 went to play outside and was picked up by their parent soon after. Deas stated teacher S3 was on the play yard supervising the children in the morning and afternoon. Deas stated that S3 reported to her that she did not observe C1 bump into the table. Deas stated that S3 stated that C1 did not cry or notify her of any injury.

On 08/07/19, LPA conducted interviews with staff S1-S4 at the center, beginning at 02:05pm. Interviews with staff corroborated the center director’s statements. Staff interviewed corroborated that C1 along with all other children were adequately supervised during all three incidents. Staff interviewed corroborated that center staff were aware of C2’s behavioral challenges and were providing increased supervision. Staff interviewed corroborated that C1 did indeed have a bruise on their face but that the bruise was less than an inch in diameter. Staff corroborated that C1 did not cry or notify staff of their injuries while in care. Staff interviewed all stated that they do not recall observing a scratch on C1’s face at the time of pickup on 07/30/19.

During the investigation, interviews with child care clients and children were also conducted. LPA was unable to obtain corroborating information to suggest that there is a lack of supervision at the center resulting in day care children receiving injuries. During unannounced inspection visits to the facility, LPA observed fifteen children being supervised by four staff members on 08/07/19 and on 09/27/19, LPA observed thirteen children being supervised by three staff members. During both inspection visits, LPA observed staff members observing and interacting with children both inside the classroom and outside on the playground. LPA did not observe any distracted staff members. No children were observed to be left without the supervision of a staff member.

Although it was corroborated that child C1 sustained minor injuries while in care, there was not sufficient evidence obtained to substantiate that child C1’s injuries resulted due to a lack of supervision or any other deficiency of Title 22 Regulations. Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, therefore the allegations are unsubstantiated. Appeal rights were provided. Notice of site visit must be posted for 30 days from today's inspection
