An unannounced follow-up complaint investigation visit to the facility was made today by Licensing Program Analyst (LPA), Y. Yang to deliver complaint investigation findings. It was alleged that the facility is operating out of ratio. Specifically, it was alleged that on at least one occasion, a teacher was supervising more than 12 awake children without the aid of an assistant.

The LPA met with the facility’s licensee, Terry Ziegler and the center director today to discuss the investigation findings and a tour of the facility was conducted at 11:09 am. This is a preschool center without a toddler component. There were 26 children present at the facility today being supervised by four staff members. The initial investigation visit was made by the LPA on 02/09/22. During this visit, there were 27 children supervised by four staff members. The facility was operating within ratio during both inspection visits.

During the initial investigation visit on 02/09/22, the center director, Julie Ehlers (staff S1) and facility licensee (staff S5) both denied the allegation and stated that the facility is following all ratio and capacity requirements set by Title 22 regulations. The licensee and center director both stated that anytime there are more than 12 awake children present, either in a classroom or on the playground, a second staff member is also present to help provide care and supervision. The licensee and center director stated that a teacher-child ratio of one teacher or aide supervising 24 napping children is used during nap time. The licensee stated that in the event of a staff member’s unexpected absence, a substitute teacher is brought in from one of the licensee’s other centers located nearby. The licensee stated that the facility maintains an up-to-date list of qualified teacher substitutes as defined in Section 101152q(1). Licensee stated that substitutes on this list are called immediately in case of emergency or illness to meet the teacher-child ratios. The licensee and center director both stated that they are familiar with the ratio regulations for a childcare center.

During the investigation, interviews were conducted with the childcare facility’s clients and staff members S2-S4 on 02/09/22 beginning at 01:06pm. The staff members that were interviewed all corroborated the licensee’s statements. The clients that were interviewed all stated that they have not observed the facility operating over ratio.

Based on available information, the LPA’s observations, and interviews conducted, there is not a preponderance of evidence to prove the alleged violation did or did not occur. Therefore, the allegation is determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility’s licensee, Terry Ziegler. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
