13 | Licensing Program Analyst (LPA), Amy Strother made a subsequent complaint investigation inspection, for the purpose of delivering complaint findings, and met with Teacher, Debbie Elliot (S1). It has been alleged that the facility is operating out of ratio, specifically that there appeared to be a lot of kids with one teacher observed at drop off and one teacher observed at pick up.
During the initial investigation inspection on 03/26/25 LPA Strother toured the facility, received a current roster of children in care, a daily roster which includes preprinted names of each child enrolled with the arrival and departure times they are scheduled, hand written notes indicating how many children were in attendance for the day and how many children stayed for nap as well as the time each child left for the day and copies of staff timesheets for the weeks of 03/03/25 and 03/10/25. LPA conducted interviews with Center Director (D1) and 2 staff (S1 & S2).
A review of the staff timesheets and children’s daily roster for the week of 03/10/25, shows that a ratio of at least 1:12 is maintained. The facility’s form LIC9040 Child Care Facility Roster has 22 children listed as currently enrolled. This number was corroborated by interviews with staff who reported that they never have more than 22 children present and that is only on one day a week, Wednesdays, otherwise it's less children. Staff stated in interviews that there are always two staff present for nap time. A review of the daily roster for the week of 03/10/25, has 19 children in attendance on 03/10/25, with 17 staying for nap, 19 children in attendance, with 18 staying for nap on 03/11/25, 22 children in attendance, with 21 staying for nap on 03/12/25, 20 children in attendance, with 19 staying for nap on 03/13/25, and 17 children in attendance, with 17 staying for nap on 03/14/25. Staff timesheet records reviewed for the week of 03/10/25 showed two staff on the schedule during napping hours, with three staff on 03/11/25. The children’s daily roster did not show the time each child arrived, just the time the child is scheduled to arrive. A review of staff timesheets indicates that the facility has the appropriate number of staff to meet the minimum requirement of a 12:1 ratio, and often has more than the required staff at arrival times. The daily roster does include the time each child was picked up. A review of staff timesheets indicates that there were not more than 12 children remaining when staffing dropped down to one teacher at the end of the day. Based on interview, the Director does not complete a timesheet and therefore would be an extra staff when needed.
Based on interviews conducted and records reviewed, there is not a preponderance of evidence to support the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that an alleged violation occurred, therefore the allegation is UNSUBSTANTIATED.

Notice of Site Visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
