A subsequent complaint investigation inspection was conducted at the facility by Licensing Program Analysts (LPAs), Amy Strother and Sebastian Phouthavong to deliver complaint investigation findings. It has been alleged that staff discriminated against day care child, specifically that staff have had an issue with the language barrier of the parent, Adult 1 (A1) and their child, Child 1 (C1) because they do not speak English and care was terminated.

During the initial investigation visit on 02/10/22, LPA Strother requested and received a current roster of children in care, personnel report, Facility Admission Agreement, Addendum to Parent Handbook regarding COVID-19 related policies, and the Facility Annual Calendar. On 02/10/22 the center director, Karen Guerin, Staff 1 (S1) and facility licensee, Terry Ziegler (L1) were interviewed. During interviews, S1 and L1 denied the allegation and stated that although a parent, Adult 1 (A1) and therefore her child, Child 1 (C1) were recently terminated from the program, it was not due to an act of discrimination against day care child C1 or A1.

Both S1 and L1 stated that the admission agreement states that dismissal from the program may occur if a parent is a detriment to the program. S1 and L1 stated that A1’s behavior on more than one occasion has been a detriment to the program, and therefore terminated care on 02/02/22.
During the investigation, interviews were conducted with the childcare facility’s teachers, Staff 2 – Staff 4 (S2-S4) on 02/10/22 beginning at 12:50pm. The staff members that were interviewed all corroborated the center director’s and licensee’s statements, denying that staff discriminated against a day care child. Staff interviewed stated that they have had children and families enrolled at the center that speak only Spanish and Mandarin. Staff stated that two staff speak Spanish and are able to translate Spanish to English and English to Spanish when needed, and although no staff speak or understand Mandarin, they have used an iPad to translate the languages in an effort to communicate. Staff also gave examples of occasions when outside resources have been used to aide children with language delays.

Based on available information, interviews conducted and records reviewed, there is not a preponderance of evidence to prove the alleged violation did or did not occur. Therefore, the allegation is determined to be unsubstantiated.

There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility representative, Karen Guerin. Appeal rights were provided.

Notice of Site Visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
