32 | LPA observed that the bottom portion of the fence on the back of the property was in disrepair with 7 nail points exposed. Photo documentation was obtained. Children were not observed playing in the backyard during the inspection.
During the course of the investigation LPA interviewed 2 adults, Adult 1 and Adult 2 (A1 and A2) who stated that on more than one occasion multiple fence boards have been broken off of the fence. Adults interviewed stated that on one occasion, approximately 1.5 months ago, up to 3 children were observed in the neighbor’s backyard, unsupervised, stating that the children were returned to the facility through the gap in the fence after calling out for an adult, who then appeared into sight, once called. On 02/02/22 the Department received corroborating evidence which confirmed that one child was observed holding a fence board in their hand, allowing access into a neighboring property while unsupervised.
Based on interviews conducted, and records reviewed, the Licensee did not ensure that the outdoor play area was supervised while the fence was in disrepair and not fully enclosed. The preponderance of evidence standard has been met; therefore, the above allegation is found to be substantiated. California Code of Regulations, Title 22, is being cited on the attached LIC 9099-D.
LPA Strother informed facility representative, Maria Medina and licensee Emilio Perez over the phone, that this report dated 02/03/22 documents one Type A citation. Type A citations which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Strother informed facility representative and the licensee to provide a copy of this licensing report dated 02/03/22, that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with the facility representative, Maria Medina. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
