An annual required inspection was made to the facility by Licensing Program Analyst (LPA), Amy Strother and Sebastian Phouthavong. LPAs met with Licensee, Sheldon El. A review of staff records indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

During the inspection the home was toured inside and outside. The licensee and assistant, Staff 1 (S1) were supervising 12 children, Child 1 - Child 12 (C1-C12) and operating within the licensed capacity and ratio requirements. C1-C12 are all preschool age children. The facility’s operating hours are Monday - Friday 7:30am - 6:00pm. The floor plan submitted by the licensee was reviewed and verified. The off-limits areas of the home is the entire upstairs, the upstairs is made inaccessible with a gate at the bottom of the stairs. There is a neighboring studio attached to the property which has its own physical address and is not accessible from inside of the child care home. The home was observed to be clean and orderly and was at a comfortable indoor temperature. There were safe toys and equipment available for children. There is a working telephone in the home. The licensee’s pediatric CPR and First Aid certifications were reviewed and expire 2/2023. During a tour of the home cleaning compounds were observed to be on a low shelf in an unoccupied room. The room was accessible to children in care. Licensee stated that she does not have poisons on the premises and none were observed during today’s inspection. The facility's family room has a fireplace that is completely covered and inaccessible to children. Licensee stated that the fireplace is not used. LPA observed a working smoke detector, carbon monoxide detector and fire extinguisher, rated at least 2A10BC, in the home. The roster of children in care was reviewed and was current. The licensee has conducted an emergency drill within the past six months, last drill was documented on 04/11/2022.

Based on observation, the licensee did not comply with the section cited above. LPAs observed glass cleaner in the front room that was accessible on a low shelf, children were not present in the room when observed, however the room was accessible to children. Nail polish remover was observed to be present in a closed low kitchen cupboard in an area that the children have access to.

Licensee stated that she will sign a written statement stating that as an alternative to putting cleansers away in the locked location in the kitchen, staff will use the inaccessible tall sign in desk in the hallway as a temporary location to place cleansers and email statement to LPA Strother at amy.strother@dss.ca.gov by 05/19/22.

The licensee stated there are no firearms and/or other dangerous weapons in the home and none were observed during today's inspection. The children use the backyard as the outdoor play area and it is fully fenced. There were no pools or other bodies of water observed. Ten children's files were reviewed and contained required records, including required LIC9224. Personnel files were reviewed, S1's file did not contain proof of required immunizations. At 12:57pm Licensee stated that her liability insurance policy has expired. Children's files did not contain form LIC282.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with the licensee, Sheldon El.
