On 7/28/2023 Licensing Program Analyst (LPA) Julie Baptista, conducted an unannounced Annual Required Inspection and was met by Licensee, Josie Cruz. Days and hours of operation are Monday through Friday, 7:30 AM to 5:00 PM. The home has working telephone service and LPA confirmed the phone number on file.
LPA toured the home inside and outside and there were seven children in care during inspection. This is a two-story home and Licensee confirmed that the day care room and small bathroom are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible by use of gates and door locks. The parents enter the day care through the side entrance and do not enter the areas of the main house. There are two dogs in the home and Licensee understands the liability of pets around day care children and accepts responsibilities of any action taken by pets. There are no firearms or ammunition on the premises. All poisons are kept in a locked storage area. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible.
The fireplace located in the family room is covered with a screen and is not used during daycare hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate air conditioning and ventilation for safety and comfort. Safe toys and play equipment are observed.
During today’s inspection, LPA observed an in-ground pool in the backyard. Licensee currently has the backyard off-limits. The pool has a 5-foot panel fence with a self-latching gate that opens away from the pool. LPA observed there were three windows on the house which look out directly to the pool area. Licensee has a security bar on one of the windows which is locked with a key lock making the window unable to open. LPA discussed regulations with licensee which require pools to not have access directly from a door or window in the facility. Licensee stated she contacted CCL to advise about requirements during pool construction. LPA Baptista also observed CCL file notes where licensee contacted CCL staff regarding pool requirement and requested pool be approved. LPA discussed with licensee the requirement for windows to not have direct access to the pool area. LPA Baptista will conduct a Case Management visit in two weeks to review correction(s) to make windows inaccessible to pool area.

Licensee has two infants in care and documents the 15-minute sleep checks. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. Capacity as specified on the license is being maintained.
LPA reviewed a sample of children’s files and observed files were complete with emergency information as required. Licensee’s Mandated Reporter Training was completed on 7/20/23. Licensee’s pediatric CPR/First Aid expires on 11/21/23. A review of records indicates that licensee has immunization records on file for influenza, pertussis and measles.
All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Exit interview conducted and report was reviewed with the licensee, Josie Cruz.

During the exit interview, the Licensee, Josie Cruz, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

A notice of site visit was given and must remain posted for 30 days.
