Licensing Program Analyst (LPA) Martinez conducted an unannounced visit in regards to an incident that occurred 4/19/19. LPA Martinez did receive a call from the Director on 4/19/19 regarding the incident when a child was left in the classroom napping while staff and students went outside to play. LPA received an incident report regarding the incident on 4/23/19 via email. LPA Martinez conducted interviews with staff S1,S2 and the director during todays visit. It was stated that child C1 was not feeling well and was laying down inside the classroom while children were outside to play. A staff S3 stated to S1 that she would watch C1 while they waited for a parent to pick up. S1 stated she observed S3 leave the building but assumed since S3 stated she would watch the child that S3 had the child upon exiting. S1 then exited the building thereafter. S2 stated she walked into the building to put her purse down and continue her 30 minute break when she heard a sound coming from the main room. S2 stated she walked over to the main area and observed C1 standing rubbing their eyes. S2 did look around to seek staff however determined C1 was alone. S2 took the child outside to locate staff. Staff nor the Director could determine exactly how long C1 was left alone in the room however it is stated anywhere from 5 to 20 minutes that the child was left inside alone while napping. This incident constitutes an absence of supervision. The incident was self reported to the Department within 24 hours or the next business day, as required.
Notice of Site Visit shall be posted for 30 days from today's visit.

The following violation of the CA Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Reports citing Type A violations are to be provided to parents/guardians of children currently enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC 9224 to be kept in each child's file. This report was reviewed with the director. The director was provided a copy of their appeal rights (LIC 9058 12/15) and her signature on this form acknowledges receipt of these rights.

Care and Supervision. No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1). This requirement was not met as evidenced by; Based on interviews it was determined a child was left in the building for approximately 5-20 minutes alone. Staff was

The director has implemented a new system of checking ratio and accountability. The staff mentioned in the incident was reprimanded for leaving the child unattended. LPA Martinez observed on today's date the new white boards for accounting for children in each classroom.

unaware the child had been left in the building alone until a staff member returning from lunch heard the child. This is an immediate health and safety risk to children in care. A civil penalty will be assessed for the incident.
