Licensing Program Analyst (LPA) Martinez and Wisehart conducted an unannounced complaint visit and met with Tiffany Saltaoamacchia. It was alleged children are allowed to use staff restrooms. The Director stated she did have a child who was using the staff restroom and had a letter on file dated 9/12/18 for a limited use due to embarrassment issues for child (C1). Throughout the investigation it was determined by LPA Martinez that C1 no longer used staff restroom and has since been integrated into using child restrooms. LPA Martinez interviewed 8 staff members (S1-S8) and 7 of the 8 stated the child did use the restroom with supervision by a staff member and only for a limited amount of time until the child became comfortable with using the child restroom. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

It was also alleged that the facility fails to post licensing reports. The director denied the allegation and showed me the location of previous Notice of site visits posted at the main parent entryway.

LPA Martinez observed these notices on previous occasions from past LPA’s and throughout the investigation. LPA Martinez interviewed 8 staff members all of which stated they have observed the Director post the notices upon receipt of them. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

It was also alleged staff members fail to properly supervise children in the restrooms, specifically when a teacher forgot a child behind in the restroom. Interviews with 8 staff were conducted and corroborated that they have never observed a staff member forget or leave a child behind in the restroom. The director denied the allegation stating if a staff member had left a child, she would have reprimanded the staff as well as submitted an incident report to licensing. LPA Martinez observed the facility utilizing a white board to show how many children were present or had left to use the restroom with a staff. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

It was alleged the facility is out of ratio, specifically when staff are changing diapers of children. The director denied the allegation stating children are not allowed to be enrolled unless they are fully potty trained. LPA Martinez interviewed 8 staff who stated it is a center policy that children must be potty trained prior to admittance to the facility. It was noted that children have had accidents but usually parents are called to pick up the child if additional clothes are needed. It should be noted that of the 8 interviewed staff 8 stated they had never observed a child in a diaper at the center. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.
