On 3/4/2021 at 10:11am, Licensing Program Analyst (LPA) Bianca Mendez conducted an unannounced complaint tele-inspection and met with licensee Rajwinder Kaur. The inspection was conducted via Zoom due to the COVID-19 state of emergency.
It was alleged that the licensee did not provide adequate supervision to day care children, specifically that the licensee was not home most of the day on 1/5/2021. It was also alleged that there were inappropriate interactions between children in care, specifically that C1 made inappropriate comments to C2, and the assistant provider (A1) did not intervene.
The licensee was interviewed on 1/15/21 at 2:10pm and denied the allegations. The licensee stated that she leaves the daycare occasionally, but the children are cared for by an assistant (A1). The licensee stated that there was an incident between C1 and C2 on 1/4/21 where C1 spoke to C2 inappropriately, and that C1 was terminated from care on 1/5/21 due to their behavior. The assistant provider was interviewed on 4/5/21 at 9:27am and stated C1 had good and bad days. C1 appeared to be angry and would use foul language toward their mother. C1 had broken their own computer twice and C1 had also punched C2 and C2 cried when they were hit. Several parents were contacted. Four parents were interviewed on 1/14/21, 2/10/21, 3/19/21 and two children were interviewed on 1/14/21. The interviews stated that while licensee is out, children are left under the supervision of A1. Children are supervised either with licensee or assistant. LPA Mendez spoke with the parent of C1 and confirmed that child care had been terminated based on child’s behavior. Based on evidence LPA obtained per above although the allegation may have happened or is valid there is not a preponderance of the evidence to prove that the alleged violation occurred and so the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
