On 09/13/2023, Licensing Program Analysts (LPAs) LPA Jose Penate and Claribel Soto arrived at facility to conduct an unannounced complaint inspection to investigate the allegation that was called into the Fresno Regional office. LPA Penate spoke with Director, Kimberly Dagliero-Sa and discussed the purpose of the inspection.

Based on interview and record review, conducted at the facility. Upon discussion with staff and LPA Observance while conducting inspection, it was determined that the facility has an adult that was recently hired for office work only. Staff #1 was hired to only work in the office and was not assisting with children in classrooms. Staff #1 was never alone with children but did have access to children at the facility. Staff #1 did not have fingerprint clearance to be at the facility with children in care.

Based on statements from staff, and observation by LPAs during this investigation, the allegation of, uncleared adult working at the facility, was investigated and the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED.

Per California Code of Regulations, Title 22, Division 12, the following deficiency is being cited on the attached LIC9099-D, see next page.

Exit interview was conducted with Director, Kimberly Dagliero-Sa.

A Notice of Site Visit Form was left with Director.

The Director was provided a copy of their appeal rights and their signature on this form acknowledges receipt of this form.

Today, LPAs witnessed Staff #1 at the facility while children are in care. During records review, LPA confirmed that Staff #1 is not fingerprint cleared through the Department, and associated to this CCC as required. This poses an immediate health, safety, or personal rights risk to children in care. A civil penalty of $300.00 was assessed.	8 9 10 11 12 13 14	Diretor was advised that until criminal background clearance is obtained, the aforementioned staff member is not permitted to provide child care services at the CCC.
