On 9/9/2022, Licensing Program Analyst (LPA) Ocegueda conducted an unannounced complaint inspection at the facility. LPA Ocegueda provided identification and informed representatives of the reason for the inspection. LPA met with Vidala Gallegos (Preschool Facilitator) and Jayboy Camaquin (Expanded Learning Administrator) today. LPA toured the facility and took a census.

During the course of the investigation, LPA Ocegueda conducted interviews of staff and reporting party (RP). Today, LPA Ocegueda observed 19 children in room 412 napping on the floor with no mats or cots as required per the regulation. The children have been enrolled since the school year began on 8/9/2022 and have not had mats or cots. Children in room 412 are present from 8:00 AM to 2:00 PM and children in classroom 413 are only present for half day (3 hours) at a time. The facility has purchased mats and they arrived yesterday; however they were not being used today. LPA observed the new mats in the packaging today. LPA provided written regulation information related to Napping (Activities CCR 101230).

This agency has investigated the complaint allegation stated above and have found that the complaint was SUBSTANTIATED, meaning the preponderance of evidence standard has been met.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiency was cited (see LIC 9099-D).

An Exit interview was conducted with representatives Vidala Gallegos and Jayboy Camaquin. Appeal Rights were provided.

Today, LPA observed children napping without mats or cots and representatives confirmed the observation. This poses a potential risk to the health, safety and or personal rights of children in care.	8 9 10 11 12 13 14	They were delivered to the classroom while LPA was present today. Deficiency cleared today 9/9/2022.
